B. REQUEST INFORMATION:
1. The following is a request that the Sun West Subd's PUD/ZDA Agreement between the City of Twin Falls, Idaho
and BCM&W Family LP, KLS&M Family LP, Canyon Vista Family LP & Lazy J Ranch, Inc.
be AMENDED as follows: See Attached.

C. PRIOR TO ACCEPTANCE/SCHEDULING OF THE APPLICATION THE APPLICANT MUST PROVIDE THE FOLLOWING:
1. The applicant must prove control of the property for which the request is being made by providing ONE of the following:
a. Copy of Warranty Deed, or
b. Copy of Earnest Money Agreement orContract of Sale,duly acknowledged by BOTH Buyer and Seller.
2. Property Notification List
The applicant must provide a consolidated list of names and addresses of all property owners within the specified distance from
the subject property perimeter as listed below.
The Director of Planning and Zoning may require notification to additional areas which may be impacted by the proposed change.

• ATitle Company of your choosing.
The completed list of names, addresses, and parcel numbers must be submitted back to the Zoning &Development Departmei
in order for your request to be scheduled for a public hearing.
3. Provide a Detailed Written Statement On A Separate Sheet Of Paper Containing:
a. Explain in detail the reason for the request; describe/include the specific changes and how they differ from the
approved PUD/ZDA and the Master Development Plan.
b. Submit the current PUD/ZDA showing the proposed changes and include an
Amended Master Development Plan(callor).
c. Explain in detail how this change could effect the development.
d. Explain in detail how this change could affect the surrounding area.
Planning and Zoning Application Refund Policies and Procedures
A refund for a portion of the application fee may be granted, provided a written request is made by the applicant, requesting the withdrawal of
application, and is subject to the guidelines listed below:
• 85% of application fee may be refunded if no staff application review has been completed.
• 50% of application fee may be refunded once staff review has been completed.
(within 35 days of Public Hearing)
• No refund for permit applications withdrawn after Public Hearing Agenda has been posted.
(within 48 hours of Public Hearing)

Application Process:
1. Contact the Planning&Zoning Department,735-7267 or 203 Main Avenue East,to determine basic zoning regulations and
application procedures.
2. Submit the application with the required attachments and fees, (see application) (Milestone 1)
3. Staff reviews the completion of the application and the need for additional information if necessary.
4. Once staff has determined the application is complete and ready the request is scheduled for a public hearing. (Milestone 2)
5. Once scheduled staff submits the public hearing information to the Times News for publication.
6. A Public Notice Packet will be emailed to the applicant with instructions for mailing and signage posting deadlines.
7. The applicant is required to mail a copy of the public notice letter provided by the City of Twin Falls to each property owner within a
specified perimeter of the property under review,and any additional area that may be impacted by the proposed change as determined by
the Zoning Administrator.
8. The applicant is required to submit a signed Affidavit of Mailing and Posting to the Planning &Zoning Department as proof that the letters
were mailed and the public notice sign was posted within the specified time (Note: If the mailing and posting requirements have not beer
met the request will be withdrawn from the agenda.)
9. A staff report regarding the applicants request, including-staff analysis and recommendations,will be emailed to the applicant prior to the
public hearing. (Milestone 3)
10. The public meeting is held at Twin Falls City Council Chambers, 203 Main Avenue East, beginning at 6:00 p.m.on the scheduled date.
11. At the public meeting,staff will present their analysis of the request and make recommendations as necessary for the Planning&Zoning
Commission to consider.
12, The applicant, or applicant's representative,shall present the request to the commission.This person should be prepared to answer any
questions the Planning&Zoning Commission may have,and address any concerns presented by the public at the time of the hearing.
13, The Planning&Zoning Commission will then deliberate and make a recommendation for approval to City Council, based on the
evidence presented,and the recommendations made by the staff regarding the request.
14. The Public Notice process steps repeat for City Council.
15. City Council will hold a Public Hearing and make a decision based on the evidence presented at the hearing,staff
recommendations and the recommendation from the Planning and Zoning Commission,
16. The applicant or any affected person(s)who appeared in person or in writing before the Commission may appeal the decision of the
Commission to City Council, provided a completed Appeal application,with payment, is submitted to the Planning and Zoning Department
within fifteen(15)days from the Commission's action.
17. Upon receipt of an appeal request due to the actions of the Commission,the City Council shall set a public hearing date, under the same
provisions as the Commission hearing,to consider all information,testimony and the Commission's minutes of the public hearing to reach a
decision to uphold, conditionally uphold,or overrule the decision of the Commission.

Reason for Request
The reason for the requested Amendment to the PUD is to allow development of commercial building
with outdoor storage and display of products for sale as currently allowed in a C-1 Zone.
The proposed change will have no impact on the other portions of the Sun West PUD. Others then allow
similar development in C-1 Zone.
The proposed change will have no impact on surrounding areas.

THIS SPECIAL WARRANTY DEED made effective as of this 2nd day of October,
2018, between BCM&W FAMILY LIMITED PARTNERSHIP, an Idaho Limited Partnership
("Grantor"), and DeVan, LLC, an Idaho Limited Liability Company, whose address is 1952 E
3600 S, Wendell, Idaho 83355 ("Grantee"), witnesseth:
That Grantor, for and in consideration of the sum of Ten Dollars and No Cents ($10.00),
and.other good and valuable consideration, the receipt whereof is hereby acknowledged, does, by
these presents, convey unto Grantee and its successors and assigns forever, all the following
described real estate situated in the County of Twin Falls , State of Idaho.

HEREIN. Hereinafter referred to as "Burdened Property."
Subject to the restriction that the Burdened Property shall only be used as a car wash.
This restriction shall be a burden upon the Burdened Property, shall run with the land, and shall
be for the benefit of Grantor, and Grantor's successors, assigns and affiliates, and for the benefit
of and appurtenant to each and every part of the property described on Schedule II attached
hereto and made a pant hereof, whether owned or leased, in whole or in part, by Grantor, or
Grantor's successors, assigns or affiliates (such property being collectively referred to as
"Bepefitted Property"), For purposes of the preceding sentence, "affiliates" shall mean a any
company in which Grantor, its successors or assigns own (directly or indirectly) five percent
(5%) or more of the voting stock or interest or which is a company that owns (directly or
indirectly) five percent (5%) or more of the voting stock or interest of Grantor, its successors or
assigns. The term of this restriction shall be for a period of sixty-five (65) years from the date
hereof. If in any judicial proceeding a court shall hold that the duration, scope or area
restrictions stated in this restriction are unreasonable under circumstances then existing, the
parties, and their respective successors, assigns and affiliates, agree that the maximum allowable
duration, scope or area reasonable under the circumstances shall be substituted for the duration,
scope or area stated in this restriction,

Reserving unto Grantor any and all rights and easements of record which benefit any of
Grantor's other property,
Together with all and singular the tenements, hereditaments, and appurtenances thereunto

title and interest in and to the Burdened Property, as well in law as in equity, except as expressly
provided otherwise herein.
To have and to hold, all and singular the above-described Burdened Property together
with the appurtenances unto Grantee and its heirs and assigns forever.
Grantor makes no covenants or warranties with respect to title, express or implied, other
than that previous to the date of this instrument, Grantor has not conveyed the same estate to any
person other than Grantee and that such estate is at the time of the execution of this instrument
free from encumbrances done, made or suffered by the Grantor, or any person claiming under
Grantor, subject to any and all easements, restrictions, agreements and encumbrances of record

TOGETHER WITH all buildings, structures and improvements thereon, if any, and any
rights of ways, easements, tenements, hereditaments and appurtenances thereunto belonging or
in anywise appertaining, the reversion and reversions, and the remainder and remainders thereof
and the rents, issues and profits thereof(collectively the "Premises").
This grant is MADE SUBJECT TO the restriction and condition that neither the Premises
nor any improvement thereon may be used for the sale, storage, use, or manufacture of firearms
("Use Restriction"). For purposes of the Use Restriction, the term "firearm(s)" means (a) any
weapon (including a starter gun)which will or is designed to or may readily be converted to expel
a projectile or projectiles by the action of an explosive or other propellant; (b)the frame or receiver
of any such weapon; or (c) any firearm muffler or firearm silencer. The Use Restriction shall be

Restriction shall run with the land, and shall remain in full force and effect in perpetuity. If in any
judicial proceeding a court of competent jurisdiction holds that the duration or scope of the Use
Restriction is unreasonable under circumstances then existing, the parties thereto (and their
respective successors, assigns and affiliates) agree that the maximum allowable duration and
scope reasonable under the circumstances shall be substituted for the duration and scope of the
Use Restriction, as applicable. If the Use Restriction is breached, Grantor and Grantor's
successors, assigns, and affiliates shall be entitled to immediately pursue, without notice or
demand, any and all available remedies to which they may be entitled at law or in equity.

TO HAVE AND TO HOLD said Premises unto Grantee and Grantee's successors and
assigns forever.
Grantor makes no covenants or warranties with respect to title to the Premises, express
or implied, other than (i) that previous to the date of this instrument, Grantor has not conveyed
