Parking: Must be made available on site. Physical Characteristics: Existing nonconforming commercial building (recently Indoor Garage Sale) and active tri-plex. ANALYSIS: The site is located in an R-4 PRO zoning district of the City. In that district a special use permit is required to operate a bridal shop. This property has been nonconforming for years (20+) and has had several commercial uses in it. It has been vacant for over a year. City Code 10-3-4(A)1 a states when a nonconforming use involving a building is discontinued for use for a period of one year the property shall conform to the current provisions of the City Code This facility currently has a building of 1748 sq ft. The site plan shows landscaping and off-street parking to meet code requirements. There is a triplex on the site, in addition to the commercial building. The site plan shows 7 off-street parking spaces for the commercial building and 6 for the three apartments, all of which require backing into the street. Although the parking is nonconforming, this parking configuration was approved for the special use permits granted in 1999 and 2000 for a second hand store. Given the site development there are no other satisfactory options for parking for the site. There is a signage notation on the site plan. Signage approval is not a part of this application. Applicant has applied for a Special Use Permit to operate a bridal shop as a cottage industry on property located at 304 Blue Lakes Boulevard. 2. All legal requirements for notice of public hearing have been met with advertisement taking place on the following date: October 24, 2002. 3. The property in question is zoned R-4 PRO pursuant to the Zoning Ordinance of the City of Twin Falls. The property is designated as professional office in the duly adopted Comprehensive Plan of the City of Twin Falls. 4. The existing neighboring land uses in the immediate area of this property are: to the north, residential; to the south, 3'd Ave E/residential; to the east, alley/residential; to the west, Blue Lakes Boulevard/residential. 5. The proposed use is consistent with the purpose of the R-4 PRO Zone and would not be detrimental to any outright permitted uses or existing special uses. 6. Additional findings: 1) The requested use of a bridal shop should cause minimal impacts to the surrounding neighborhood. 2) This request complies with code requirements except the parking plan. The parking plan was approved by the Engineering Department under Special Use Permit #0629 and #0707. There have been no negative impacts from the approved parking plan. Based on the foregoing Findings of Fact, the Planning and Zoning Commission hereby makes the following CONCI i I-SIGNS OE i nw 1 . The application for a Special Use Permit to operate a bridal shop as a cottage industry on property located at 304 Blue Lakes Boulevard is consistent with the purpose of the R-4 PRO Zone, and is not detrimental to any of the outright permitted uses or existing special uses in the area. 2. The proposed use is consistent with the provisions of the Comprehensive Plan and Zoning Ordinance of the City of Twin Falls, and in particular Sections 10-1-4, 10-1-5, 10-4- 18.2(B)4(b)2, 10-9-1 & 2, 10-10-1-3, 10-1 1-2, 10-13-2.2 Twin Falls City Code. 3. The proposed use is a proper use in the R-4 PRO Zone. 4. The application for a Special Use Permit to operate a bridal shop as a cottage industry on property located at 304 Blue Lakes Boulevard should be granted, subject to all applicable requirements of the Zoning Ordinance, Adopted Standard Drawings and City code of the City of Twin Falls. Based on the foregoing Conclusions of Law, the Twin Falls City Planning and Zoning Commission hereby enters the following DECISION 1 . The application for a Special Use Permit to operate a bridal shop as a cottage industry on property located at 304 Blue Lakes Boulevard is hereby granted. 2. The applicant shall comply with all applicable requirements of the Adopted Standard Drawings, the Zoning Ordinance, and the City Code of the City of Twin Falls. 3.
