made by providing ONE of the following:

b. Copy of Earnest Money Agreement or Contract of Sale, duly acknowledged
by both Buyer and Seller.
C. Copy of Lease Agreement AND Owner's Written Consent.
2. A list of names and addresses of all property owners within three hundred (300)
feet of the perimeter of the subject property.
(This can be obtained through a title company or the Assessor's Office in the
County Courthouse.)
3. A plan to scale, on 81/2" x 11" paper, of the subject property showing the following
information:
a. lot dimensions, location of all buildings, parking and loading areas, adjacent
streets with traffic access and traffic circulation, open spaces, landscaped
areas, refuse and service areas, utilities, signs, setbacks, fences, etc.
b. If new buildings are proposed, elevations are required.
4. On a separate sheet of paper please provide a detailed written statement containing:
a. The reason for the request.
b. An explanation of the project, including hours of operation, traffic
anticipated, number of employees, etc.
C. An evaluation of the effects on adjoining property; the effect of such
elements as noise, glare, odor, fumes and vibration on adjoining property;
together with a discussion of the general compatibility with adjacent and
other properties in the district.

Your zoning request is scheduled to be heard before the Twin Falls City Planning & Zoning
Commission at 7:00 P.M. on Tuesday, December 12, 2000, at the City Hall Council
Chambers, located at 321 Second Avenue East.
IT WILL BE NECESSARY THAT YOU OR YOUR REPRESENTATIVE ATTEND THAT
MEETING TO EXPLAIN YOUR REQUEST AND TO ANSWER ANY QUESTIONS THE
COMMISSION MAY HAVE. ENCLOSED IS A SHEET EXPLAINING THE HEARING
PROCEDURES.
Enclosed is the letter of notification of the public hearing, the list of property owners
within three hundred feet of the subject property and an affidavit. Please mail a copy of
the notification letter to all property owners on the fist at leas 15 days prior to the pub/ic
hearin , fill in the TOP part of the affidavit and return the affidavit, the list and one copy
of the notification letter to my office by Tuesday, December 5, 2000. If the notification
letter is not mailed at least 15 days prior to the public hearing or if my office has not
received your affidavit of mailing by December 5, 2000, the hearing will be cancelled and
new notice will be provided at your expense.
State law also requires that the property be posted with a notice of the request at least
one week before the hearing. Please post a notice of the public hearing in.a conspicuous
location on the subject property by December 5, 2000.

The Planning and Zoning Commission for the City of Twin
Falls will hold a public hearing at 7 o'clock, P.M. , on the 12th
day of December, 2000, a Tuesday, in the City Hall Council
Chambers, located at 321 Second Avenue East, Twin Falls, Idaho,
to consider the application of Frank J. (Jim) Davis for a
Special Use Permit which, if granted, would allow the applicant
to operate a beauty salon as a home occupation on property
located at 830 Filer Avenue in the City of Twin Falls .
Any and all persons desiring to comment may appear and be
heard at the appointed time.

HEARING PROCEDURES FOR ZONING REQUESTS
BEFORE
THE TWIN FALLS CITY PLANNING & ZONING
COMMISSION
AND
THE TWIN FALL CITY COUNCIL
1. A spokesman for the applicant will make a presentation on the
request. The presentation should fully explain the following:
• Exact location of the property. (An overhead projector is available
for maps, site plans and other drawings)
• A complete explanation and description of the request. (Size of
property and buildings, building elevations, hours of operation,
traffic anticipated, parking, landscaping, etc)
• Why the request is being made.
• Impacts on surrounding properties and efforts to mitigate those
impacts.
2. City staff will make comments and state the staff recommendations.
3. The Commission/Council may ask questions to clarify the project.
4. The public hearing will be opened and anyone wishing to present and
rebut evidence will be allowed to do so. The Commission/Council
may establish a time limit for each speaker.
5. After public comment, the applicant's spokesman will be allowed to
respond to evidence presented and to make final comments. If the
applicant introduces any new matter not previously presented, the
public may be allowed to present additional evidence.
6. The public hearing will be closed and no further comments will be
taken from the applicant or the public.
7. The Commission/Council will discuss the application and may render
a decision or allow the application to continue to another public
hearing. During the Commission's/Council's discussion, questions of
the applicant's spokesman or of the public may be asked.

ANALYSIS: The applicant operated a beauty shop as a home
occupation for several years after receiving a special
use permit (permit #261) for a home occupation in
1989. Conditions placed on the special use permit
were met. Subsequently another beauty shop
operator continued the shop, but was not operating
as a home occupation in this R-2 zoning district.
She later relocated her shop elsewhere.
During the time the shop was operated from the site
City staff received no complaints. Impacts of this
operation should be minimal on surrounding
properties.
Traffic parking arrangements that require backing a
vehicle directly into a collector street violates City
Code Section 10-10-2(B). The existing parking
spaces behind the building do not provide adequate
space for a turn-around to re-enter Filer Avenue
facing forward.
RECOMMENDATIONS: Staff recommends the following condition be placed
on this permit, if granted:
1. Widen the parking area behind the building to a
minimum width of 40 feet, allowing 2 feet of
overhang over the lawn, front and rear, for
maneuvering.

This matter having come before the Planning and Zoning Commission of the City of
Twin Falls, Idaho on December 12, 2000 for public hearing pursuant to public notice as required
by law for a Special Use Permit to operate a beauty salon as a home occupation on property
located at 830 Filer Avenue, and the Planning and Zoning Commission having heard testimony
from interested parties being fully advised in the matter, now makes the following
FINDINGS OF FACT
1 . Applicant has applied for a Special Use Permit to operate a beauty salon as a
home occupation on property located at 830 Filer Avenue.
2. All legal requirements for notice of public hearing have been met with
advertisement taking place on the following date: November 23, 2000.
3. The property in question is zoned R-2 pursuant to the Zoning Ordinance of the
City of Twin Falls. The property is designated as urban residential in the duly adopted
Comprehensive Plan of the City of Twin Falls.
4. Relevant criteria and standards for consideration of this application are set forth in
Sections 10-1-4, 10-1-5, 10-4-4.2(B)6b, 10-13-2.2, Twin Falls City Code.
5. The existing neighboring land uses in the immediate area of this property are: to
the north, Filer Avenue/residential; to the south, residential; to the east, residential; to the west,
residential.
• 6. The proposed use is consistent with the purpose of the R-2 Zone and would not
be detrimental to any outright permitted uses or existing special uses.
7. Any detrimental effects on the neighborhood would be ameliorated by observance
of the conditions which are attached as "Exhibit No. A", and incorporated by reference as though
fully set forth herein.
8. Additional findings: 1) The applicant stated he will operate his business from
7:00 a.m. to 5:00 p.m., Monday thru Saturday. 2) The applicant agreed to comply with the
condition placed on the special use permit.
Based on the foregoing Findings of Fact, the Planning and Zoning Commission hereby
makes the following
CONCLUSIONS OF LAW
1 . The application for a Special Use Permit to operate a beauty salon as a home
occupation on property located at 830 Filer Avenue is consistent with the purpose of the R-2
Zone, and is not detrimental to any of the outright permitted uses or existing special uses in the
area.
2. The proposed use is consistent with the provisions of the Comprehensive Plan and
Zoning Ordinance of the City of Twin Falls, and in particular Sections 10-1-4, 10-1-5,10-4-
4.2(B)6a. 10-13-2.2 Twin Falls City Code.
3. The proposed use is proper use in the Special Use Permit to operate a beauty
salon as a home occupation on property located at 830 Filer Avenue Zone, subject to the
conditions which are attached as "Exhibit No. A", and incorporated by reference as though fully
set forth herein.
4. The application for a Special Use Permit to operate a beauty salon as a home
occupation on property located at 830 Filer Avenue should be granted, subject to all applicable
requirements of the Zoning Ordinance, Adopted Standard Drawings and City code of the City of
Twin Falls and to the conditions which are attached as "Exhibit No. A", and incorporated by
reference as though fully set forth herein.
Based on the foregoing Conclusions of Law, the Twin Falls City Planning and Zoning
Commission hereby enters the following
DD CSION
1 . The application for a Special Use Permit to operate a beauty salon as a home
occupation on property located at 830 Filer Avenue is hereby granted, subject to the conditions
which are attached as "Exhibit No. A", and incorporated by reference as though fully set forth
herein.
2. The applicant shall comply with all applicable requirements of the Adopted
Standard Drawings, the Zoning Ordinance, and the City Code of the City of Twin Falls and
