Such applioadon or release shall not ours or waive any default or notice of default hereunder or invalidate any act done pursuant to such notice. 3. To appear In and defend any action or proceeding purporting to affect the security hereof or the rights or powers of Beneficiary or Trustee;and to pay.all costs and expenses,including costs of evidence of title and attorney's fees in a reasonable sum,in any such action or proceeding in which Beneficiary or Trustee may appear. 4. To pay:at least ten days before delinquency all taxes and assessments affecting said property, when due,all encumbrances, charges and liens,with interest,on said property or any part thereof, which appear to be prior or superior hereto;ON costs,fees and expenses of this Trust. In addition to the payments due in accordance with the terms of the note hereby secured the Grantor shall at the option,and on demand of the Beneficiary pay each month 1/12 of the estimated annual taxes,assessments insurance premiums,maintenance and other charges upon the property, nevertheless in trust for Grantor's use and benefit arni for payment by Beneficiary of any such Items when due. Grantors failure so to pay shall constitute a default under this trust. S. To pay immediately and without demand all sums expended by Beneficiary or Trustee pursuant to the provisions hereof with Interest from date of expenditure at eighteen per cant per annum. e. ANALYSIS: This property has been nonconforming for years (20+) and has had several commercial uses in it. The major problems with the site are off-street parking and arterial landscaping. There is no place on the site to provide adequate off-street parking. There is a triplex on the site, in addition to the commercial building. To re-establish a non- conforming business would require the general standards applicable to special uses plus the applicant must show the building cannot reasonably be converted to a conforming use. The site plan shows 7 off-street parking spaces for the commercial building and six for the three apartments, all which require backing into the street. City code prohibits the backing of vehicles into the public right-of-way from commercial buildings. The parking for the site will need to be redesigned. The application for a Special Use Permit to re-establish a 2nd Hand Store on property located at 304 Blue Lakes Boulevard is consistent with the character of the neighborhood, and is not detrimental to any of the outright permitted uses or existing special uses in the area. 2. The proposed use is consistent with the provisions of the Comprehensive Plan and Zoning Ordinance of the City of Twin Falls, and in particular Sections 10-1-4, 10-1-5, 10-3-4(A)e, 10-10-3, 10-11-2, 10-13-2.2, Twin Falls City Code. 3. The application for a Special Use Permit to re-establish a 2nd Hand Store on property located at 304 Blue Lakes Boulevard should be granted, subject to all applicable requirements of the Zoning Ordinance, Adopted Standard Drawings and City code of the City of Twin Falls and to the conditions which are attached as "Exhibit No. A", and incorporated by reference as though fully set forth herein.
