Ryan,
As Lisa has explained below, the floor plan you provided doesn’t give us sufficient enough information for us to
determine that he building in its current form is fully safe for all occupants because of all the changes that have
happened to the spaces over the years. Because of this, our Building Official Matthew Long is asking that an
architecturally drawn floor plan (stamped by an Idaho licensed Architect), be provided to the building department
for review. This is similar to what we asked Canyonside Labs to do for us. If there is no construction that you are
doing inside the building, we are willing to do this as a zero dollar permit, but we would like that architect provided
drawing so that we can get Ajia off on the right foot as the new owner. If no construction is going on inside the
building, the application for a Certificate of Occupancy only would be the one you would use in this
circumstance. https://www.tfid.org/DocumentCenter/View/6431/2024-Commercial-Change-of-Occupancy-app
If you would like to discuss this further, please feel free to reach out to us.
Respectfully,
Jon Victor

Good Morning,
After discussing concerns with the unsafe to occupy status associated with the
building, I met with my supervisor, fire marshal and the building department to
determine whether or not the floor plan provided would allow me to issue the sign
permit.
It was decided that the floor plan is insufficient and I am not going to be able to
approve the sign permit for Spot On. The plans do not provide tenant information nor
does it clarify the uses that are in the building currently. The discussion yesterday
1
revealed that the Unsafe to Occupy “red tag” posted on the building was for the entire
building. I have included Jon Victor on this email, he will be clarifying the steps you will
need to operate a business in the building.

Hi Lisa,
Sounds great. Attached is the main floor layout, and sounds good for the 2nd level when that time
comes.
First level tenants are Real Deals Decor and their use is storage of home decor items. And the other
tenant is Spot On, who we discussed above.

Ryan,
Please provide a to scale drawing of the floor layout listing the tenants and what type
of use or business they operate. When you submit for occupancy of the second floor
this information will be needed from the architect or engineer, however for me a
drawing to scale with this information should be sufficient for me to approve the sign
permit.

Spot on is a bottling, warehousing and distribution business. So there is no change of use from
before. For main level layout we have a simple hand drawn one that I will mark up with the tenants and
send over
The upstairs is not occupied, and will stay that way until we have occupancy up there.

Ryan,
After speaking with Matthew, we just have a few more questions. What type of
business is Spot On? Where will the business be within the building. Please provide a
floor plan of the building labeling the different businesses that are operating in the
building. We also wanted to clarify that nobody can use the upstairs portion of the
building until occupancy has been resolved for that space. As soon as we have this
information, I will be able to finish my sign permit review.

Thanks Lisa. And we will continue on with the steel stairs and ada ramp and then call in for final on
that, so the upstairs has two points of egress. Historical committee is all passed off. Making good
headway just didn’t want to take a step backward with the bottom floor tenant. Thanks for the help

It was all discussed in our meeting we had with the city after the below message was
received. We received that email then scheduled the meeting. In the meeting it was
determined that the "do not occupy" should be enforced to for the upstairs portion of the
building only. And that the tenants that have been in the bottom portion the whole time
are fine. We were told if we had the stairway permitted and built and then go through the
certificate of appropriateness committee for the exterior changes that we could then file
for occupancy for the upstairs. The committee fully approved our changes and signed off
and now we have a permit open for the staircase and are working with EHM and a
contractor to build the steel staircase.
It was determined in the meeting that the downstairs had nothing to do with the staircase
and was fine to not kick tenants out for a staircase that had nothing to do with them.
Please let me know if that has changed and we need to remove tenants or if we can
continue on with our original approved plan of action that is now almost complete.
Thanks,

to me, Jarrod, Kelly
Ryan,
I spoke with the building department regarding the occupancy for this
building. Jarrod Bordi, explained that the unsafe to occupy signage
indicates that the building cannot be occupied until the investigation and
issues have been resolved. He suggested that you set up a meeting with
the building department to discuss the issues and the you include an
architect or engineer in the discussion. The building is also located with
he Warehouse Historic District any exterior modifications such as
stairways, signs, window and door alterations or improvements have to
be approved by the Historic Preservation Commission. Please contact the
building department to set up an appointment to discuss requirements for
occupancy. I have included Kelly Wright, Admin Assistant so that she can
set up a meeting.

Ryan,
Do you have any documentation from Matthew regarding the issues
related to the do not occupy posting and what would be needed to bring
it back into compliance. Any documentation you can provide would be
appreciated and beneficial.

Happy to jump on a call also. This is just totally different info than what was provided to
us in our meeting with M. Long

I suppose Im still confused,
There are businesses there that have been there for years , the other thing that has
happened is the stairwell was removed and that caused the upstairs to be
occupiable until that was permitted and put back. One of the ground floor tenants has
been there for over 10 years. Why all the sudden is a site plan needed to keep
operating?

Ryan,
When you apply for the Certificate of Occupancy/Tenant Improvement
permit the requirement by code is that you submit a site plan. This site
plan will show the property boundaries, the required landscaping, the
trash enclosure, parking and items that are required to obtain a
certificate of occupancy. Once this site plan has been approved, I can
approve the sign permit. For this location the most significant
requirement for zoning will most likely be a trash enclosure, the M-2
zone does not require hard surfacing and there is minimal landscape
requirements for this zone also. However, I will still need this site plan
in the application packet when you are ready to apply for occupancy.
6
In the mean time there cannot be any businesses operating out of this
building without establishing the occupancy and getting the certificate.

Hi Lisa,
We have a permit in for the stairs and ramp rebuild. These two items were the
resolution of what the City wanted have done after our in person meeting regarding
this building.
I know Lytle signs cant get their sign permit until the C of O is issued and we are
waiting on the stairs for to apply for that C of O.
But Lytle also received the below message stating we need more things like a site
plan. Can you explain to me what changed since the meeting and if we actually need a
full site plan?
Good Afternoon,
Per City Code 10-9-8 (T) a. Time
A sign permit shall not be issued to erect or place a wall sign on a property
until a site plan and/or final plat has been approved by the city for
7
development of the property and after the issuance of a building permit for
a building on the property.
Currently we only have an application to repair the stairs and install a ramp
this permit does not require an approved site plan and we do not have an
plans to review for occupancy of the building to be established.
Until these requirements have been met I will be able to approve the permit.
