TWIN FALLS CITY PLANNING AND ZONING COMMISSION MEETING & PUBLIC HEARINGS

The meeting was called to order by Chairman, Florence. He then explained the public hearing and
appeal procedure to the audience and said that a three minutes time limit would be put on each speaker.
PUBLIC HEARINGS:
Item #1 Request of Glenn Rains for a Zoning District Change and Zoning Map Amendment from
R-1-43,000 to R-2 for property located in the vicinity of Filer Avenue West and Grandview
Drive. WITHDRAWN
Item #2 Request of Dave and Mary Ann Rice dba The Health Food Place for a special use permit
to operate a business with a drive-in window at 1703 Addison Ave E. WITHDRAWN
Item #3 Request of the Idaho Migrant Council for a Special Use Permit to place a classroom
module adjacent to the existing Migrant Headstart facility located on property at 1122
Washington Street South.
Community Development Director Orton reviewed the request using overhead projections.
He said staff recommends that the following conditions be placed on the permit, if granted:

1. Site plan to be amended to show 12 off-street parking spaces and a pick-up and drop-off
area. (Conditions on 1991 Special Use Permit)
2. Required parking is to be paved. (Conditions on 1989 Special Use Permit)
3. Fencing is to be shown on the site plan. (Conditions on 1989 Special Use Permit)
The public hearing was opened.
Ray Crowder, Architect for IMC, spoke for the request.
The public hearing was closed.
Discussion on parking and zoning on the surrounding land followed.
Traxler made the motion to approve the request including staff recommendations and to
including creation of a new parking area. The motion was seconded by Daigle and the vote
upon roll call was as follows: those voting "AYE" - Florence, Heyer, McClusky,
Mikesell, Palmer, Stutzman, Traxler, Daigle and Dane. Those voting "NAY" - None.
The motion passed.
Item #4 Request of Amazing Grace Fellowship for a Special Use Permit for an electronic message
center sign installed on property located at 1061 Eastland Drive North.
Community Development Director reviewed the request with the Commission. He said in
the City Code there is no provision for churches to have message center signs. He said the
sign may be better as a monument sign. Staff recommends that the message center portion
of this sign be denied and only 32 sq. ft. of other signing be allowed.
The public hearing was opened.
Lynn J. Schaal, Pastor of Amazing Grace Fellowship, spoke for the request. He said the
sign had been redesigned and the message center portion was no longer being requested.
He asked the Commission to consider the new request.
The public hearing was closed.
Discussion followed.
Stutzman moved to approve the redesigned sign as shown. The motion was seconded by
Dane and the vote upon roll call was as follows: those voting "AYE" - Heyer, Mikesell,
Palmer, Stutzman,Traxler,Daigle, Dane and Florence. Those voting "NAY" -McClusky.
The motion passed.
Item #5 Request of Richard L. Beus for the Twin Falls Brewing Company for a Special Use Permit
to operate a brewery/restaurant on property located at 516 2nd Street South.
Item #6 Request of Richard L. Beus for Old Mill Building, LLC for a vacation of that portion of

2nd Street South lying between Block 154 and Block 155 of the Final and Amended Plat
of Twin Falls Townsite, bordered on the north by 5th Avenue South and on the south by
Minidoka Avenue.
Item #5 and 6 were combined together.
Community Development Director Orton reviewed the request using overhead projections.
He said staff recommended the following conditions be placed on the permit, if granted:
1. Provide off-street parking to meet code requirements.
2. Assure that the project is consistent with Old Towne planning.
3. Secure City Council approval for the on-street angle parking and/or street right-of-way
vacation necessary for the development of the site as presented.
He also said staff recommended the following if the vacation was granted:
1. A utility easement be retained on the vacated property.
2. Assure that the vacation is consistent with Old Towne planning.
3. Reconstruct the 5th Ave. S. intersection and frontage to provide positive drainage for
the area.
City Engineer Young reviewed the right-of-way widening and widening of Minidoka
Avenue.He also said truck parking was a major problem in the area.
The public hearing was opened.
Rick Beus, the applicant, spoke for the request.
David Woodhead, adjacent property owner with loading docks, expressed concerned about
the problem of Globe Feed and Seed using 5th Avenue south for parking. He was in favor
of vacating Second Street.
The public hearing was closed.
There was discussion on the following:
- The paving of 5th Avenue South.
- Street and curb, will be paved but not necessarily by the City.
- The Special Use Permit will not be heard by the City Council.
- The vacation request will go on to the City Council.

- Lighting, seating and parking in the proposed request.
Possibility of Urban Renewal Agency paving the street.
Vacating or opening 5th Avenue South.
Mikesell moved to approve the Special Use Permit application including three staff
recommendations and to add #4 — Resolution of development for 5th Avenue South
extension to meet City Standards. The motion was seconded by Dane and the vote upon
roll call was as follows: those voting "AYE" - McClusky, Mikesell, Palmer, Stutzman,
Traxler, Daigle, Dane, Florence and Heyer. Those voting "NAY" - None. The motion
passed.
The public hearing was opened on Item #6.
The applicant said he was not closing the street - they were just moving it over.
Easement retention was discussed.
The public hearing was closed.
City Attorney Wonderlich requested that:
1. The bike route easement be retained.
J2. Recommended that there be written consent of all the property owners affected by the
request.
Dane made the motion to accept the request with all staff recommendations and to add #4
Retain easement for bike paths and #5 Obtain written consent from all adjacent property
owners. The motion was seconded by Traxler and the vote upon roll call was as follows:
those voting "AYE" -Mikesell, Palmer, Stutzman, Traxler, Daigle, Dane, Florence, Heyer
and McClusky. Those voting "NAY" - None. The motion passed.
A BREAK WAS TAKEN AT THIS TIME.
Traxler stepped down from the Commission.
Item #7 Request of Lori Haszier & Ami Alberdi dba TLC For Tots, for a Special Use Permit to
operate a day-care facility on property located at 1233 Sparks Street North.
Community Development Director Orton reviewed the request using overhead projections.
He said staff made no recommendations.
The public hearing was opened.
Amy Alberdi and Lori Haszier, the applicants, spoke for the request.

Vince Alberdi, father of the applicants and owner of the duplex where the day-care facility
is proposed, spoke for the request.
The public hearing was closed.
The Commission discussed screening and fencing.
Daigle moved to accept the request. The motion was seconded by Heyer and the vote upon
roll call was as follows: those voting "AYE" -Palmer, Stutzman, Daigle, Dane, Florence,
Heyer, McClusky and Mikesell. Those voting "NAY" - None. The motion passed.
Traxler came back on the Commission.
Stutzman stepped down from the Commission.
Item #8 Request of William L. Rehwalt for a variance which would permit the construction of a
garage with a 5' setback from the property line, rather than the required 7' setback, on
property located at 315 Sunrise Blvd North.
Community Development Director Orton reviewed the request using overhead projections.
He said the property immediately to the north of the site has a 10' utility easement along
the south property line. This will preclude construction within 10' of the southern lot line.
Staff made no recommendations on this request.
The public hearing was opened.
Discussion followed on 5' and 7' setbacks and the definition of a variance.
Mikesell moved to accept the request. The motion was seconded by Dane and the vote
upon roll call was as follows: those voting "AYE" - Dane, Florence, Heyer and Palmer.
Those voting "NAY" - Traxler, Daigle, McClusky and Mikesell. The motion failed.
Florence stepped down from the Commission
Stutzman came back on the Commission and Chaired the next public hearing.
Item #9 Request of Richard Kelly for a Special Use Permit to operate a meat, produce and deli
store with a drive-in window on property located at 2223 Addison Ave East.
Community Development Director Orton reviewed the request using overhead projections.
He said staff recommends the following conditions be placed on the permit if granted:
1. Provide an analysis of the parking for both the proposed facility and the existing plant
nursery to assure off-street parking requirements are met.
2. Provide an analysis of provided landscaping to assure code compliance.
The public hearing was opened.

Dane made the motion to approve the request including staff recommendations. The
motion was seconded by Daigle and the vote upon roll call was as follows: those voting
"AYE" -Traxler,Daigle, Dane, Heyer, McClusky, Mikesell, Palmer and Stutzman. Those
voting "NAY" - None. The motion passed.
Florence came back on the Commission and resumed Chairmanship.
Item #10 Request of Wendy Kerr for a Special Use Permit to operate a beauty salon as a home
occupation on property located at 815 South Park Avenue West.
Community Development Director Orton reviewed the request using overhead projections.
He said staff recommended the following conditions be placed on the permit if granted:
1. Parking area to be paved.
2. Parking plan to meet City Code section 10-10-2(B).
The public hearing was opened.
Wendy Kerr, the applicant, spoke for the request.
The public hearing was closed.
Stutzman made the motion to accept the request with staff recommendations. The motion
was seconded by Mikesell and the vote upon roll call was as follows: those voting "AYE"
- Daigle, Dane, Florence, Heyer, McClusky, Mikesell, Palmer, Stutzman and Traxler.
Those voting "NAY" - None. The motion passed.
OTHER ITEMS:
Item #11 Consideration of the preliminary plat of the First Amended Phase 2 Plat/Breckenridge
Farms, a P.U.D.
Community Development Director Orton reviewed the PUD using overhead projections.
He said the plat had already been approved by both the Commission and the City Council
previously. Staff recommended the three conditions of prior approval and widening of Pole
Line Road should be attached to the approval of this plat. Those conditions being:
1. Access restricted from Fiilmore to:
a. A single common driveway between lots 9 and 10 (Now platted as Breckenridge
Phase 4)
b. The existing driveway between lots 11 and 13 (Now north of lot 12)

c. A common driveway between lots 15 and 16 (Now lots 13 and 14)
d. The access drive east of lot 16 (Now lot 15)
e. All other accesses to be considered by the City Council at the time of submittal of
building permit application.
2. Construction required on Pole Line Road to a width of 32 feet from centerline and
including curb, gutter, sidewalk and asphalt patch back and right-of-way dedication
from the west side of Fillmore Street to the west edge of the Woodbury property (257
feet). (This has not been accomplished)
3. Approval subject to engineering technical review.
Gerald Martens, EHM Engineers, spoke for the request.
Ned Stevenson, Woodbury Corporation, spoke for the request. He said they had no
problem with the conditions.
Mikesell moved to accept the request subject to staff recommendations. The motion
was seconded by Daigle and the vote upon roll call was as follows: those voting
"AYE" -Daigle, Dane, Florence, Heyer, McClusky, Mikesell, Palmer and Traxler.
Those voting "NAY" -None. Those "ABSTAINING" - Stutzman. The motion passed.
Item #12 Consideration of the preliminary plat of the Dunthorn's Subdivision.
Community Development Director Orton reviewed the plat using overhead projections.
He requested that the following condition be placed on the plat, if approved.
1. Subject to final technical review by the City Engineering Department.
Larry Dunthorn, the applicant, spoke for the request.
The Commission discussed canyon rim setbacks, utility easements and site drainage being
piped.
Mikesell made the motion to approve the plat subject to staff recommendations. The
motion was seconded by Traxler and the vote upon roll call was as follows: those voting
"AYE" - Dane, Florence, Heyer, McClusky, Mikesell, Palmer, Stutzman, Traxler and
Daigle. Those voting "NAY" - None. The motion passed.
Item #13 Request of Twin Falls Chamber of Commerce/City of Twin Falls Beautification Committee
for a Special Use Permit for a "Roaming Sign" .
Community Development Director Orton reviewed the request using overhead projections.
He said staff recommended the following conditions be placed on approval if granted:

2. Signs to be placed in such a way as to not create a sight hazard.
( Rex Lytle. Chairman of the Beautification Committee, spoke for the request. He said it
would be a once a year contest with three signs total.
Stutzman made the motion to approve the request including staff recommendations and
limit to three signs at any one time and the size to be as stated or smaller. The motion was
seconded by Mikesell and the vote upon roll call was as follows: those voting "AYE" -
Florence, Heyer, McClusky, Mikesell, Palmer, Stutzman, Traxler, Daigle and Dane.
Those voting "NAY" - None. The motion passed.
Item #14 Findings of fact and conclusions of law:
a. Variance request of T.W. Stivers, Bruce Mecham, William E. Cooper, Ray
Crumbliss and Harley Jensen.
b. Rezone request of David Mark Williams.
C. Rezone request of Sawtooth Construction.
The findings were approved.
Item #15 Approve minutes of May 10, 1994, Planning and Zoning Commission meeting.
Stutzman made the motion to approve the minutes with the correction of Paula Edmunds
Hollified name corrected. The motion was seconded by Dane and the motion passed by
unanimous voice vote.
Item #16 Set date of next Planning and Zoning Commission meeting.

Item #17 Councilperson Gooding asked for commission input for the public hearings that would be
on the Council agenda June 6, 1994. He requested representation from the Commission
as the meeting.
Item #18 Stutzman felt the Hudson-Jelaco comments in the paper regarding the planning and zoning
commission decisions was a kick in the teeth.

163 Second Avenue West. There was a quorum present and a motion was
made by Russ Tromayne and seconded by Doug Follow that the three Petitions
before the Board by Mr.Featherston on behalf of Trail Creek Pub&Brewing
Company,and Maniacs, a bakery and deli, for signs to be placed above their
doors with illuatrations as provided by Mr.VanBUelen of Lytle Sigs'1a Co.as
well u the replacement of thv doors that are similar to the present doors but
havo glass panels on the top two panels was approved unanimously by the
Twin Falls City Historic Preservation Commission.

It has come to the attention of the City of Twin Falls you are displaying two
free-standing signs, one at the intersection of Shoshone Street & 51h Avenue South
and the other at the intersection of Minidoka Avenue & 2' Street South. Your
property, located at , 516 2' Street South, is located in the OT Zone. Free-
standing signs in the OT Zone require approval by the Planning & Zoning
Commission. If the Commission approves the signs then City Code 10-9-1 (0)
requires the signs to obtain a sign permit from the Building Inspection Department
prior to placement. As of today's date I was unable to locate a sign permit on file
for either sign
The City of Twin Fails is requesting the signs be removed immediately. For
your convenience I have included an application for Commission Approval of a
Sign. If you wish to place these signs please fill out the application and return it

installation of columns under the landing. If the number of lag bolts is to be doubled the
connection angle would probably need to be lengthened to provide proper spacing between the

though some of the basic plans and information needed to do a
complete plan review was not included in the plans submitted.
Please be aware that the issuance of this permit cannot be
considered as approval of any type of commercial use of the

This application has been reviewed and a permit is being issued
for some structural modification of the subject building even
though some of the basic plans and information needed to do a
complete plan review was not included in the plans submitted.
Please be aware that the issuance of this permit can not be
considered as approval of any type of commercial use of the
building. Prior to the city' s issuance of a building permit which
would allow the use of the building it will be necessary for
plans to be submitted for review which will address the type of
use proposed use of all areas, structural calculations of work
proposed under this permit and any further modifications, the
exiting system for all levels and the corresponding use of all
levels. Based on the information available we have been able to
compile a list of some of the basic information or items needed
to issue a building permit and subsequent occupancy permit. (See
Attached List)
Please contact our office if you have questions. If desired we
can set up a pre-plan review meeting so that you and your
associates can meet with the city department personnel who will
be reviewing your future plans. We believe considerable time and
confusion can be avoided through such meetings.
