HomeMy WebLinkAboutStatus Change, Bailey Kemp, Effective 4_9_2023 - Attachment TWIN FALLS POLICE DEPARTMENT/CITY OF TWIN FALLS TUITION/TRAINING REINIBURSEMENT AGREEMENT This Agreement is entered into by and between the Twin Falls Police Department and the City of Twin Falls, Idaho, a municipal agency ("City") and the undersigned employee ("Employee"). WHEREAS, The City invests thousands of taxpayer dollars for the training of its police officers with the reasonable expectation that its taxpayers will receive the benefit of that training fora reasonable period of time; and, WHEREAS, The City would not invest the thousands of taxpayer dollars for the training of its police officers if those police officers intended to leave the employment of the City and take that investment with them to another entity; and, WHEREAS, it is reasonable for the City and its taxpayers to expect reimbursement from an employee for the investment made in training if they do not receive the benefit of that training for a reasonable period of time. NOW,THEREFORE, the parties hereto agree as follows: 1. IN-STATE TUITION REIMBURSEMENT: The Twin Falls Police Department has a tuition reimbursement program to reimburse in- state tuition for those employees who complete a collegiate continuing technical education law enforcement program, become POST certifiable, and successfully complete the FTO Program. In the event that the undersigned Employee, who has received tuition reimbursement, voluntarily leaves employment with the City and Twin Falls Police Department within three(3)years of the Employee's hiring date,the Employee shall repay to the City the full amount of tuition reimbursement. 2. IDAHO PEACE OFFICER STANDARDS AND TRAINING(POST): If the City and Twin Falls Police Department hired the undersigned Employee and paid him/her while attending the POST Academy and the Employee voluntarily leaves City employment within three (3) years of the Employee's graduation from POST, the City should be reimbursed its investment. Since it is impractical to accurately determine damages incurred, the parties hereto agree that Employee shall pay the City Three Thousand Dollars ($3,000.00) as liquidated damages, if the Employee voluntarily leaves City employment within three (3) years of the Employee's graduation from POST. This amount represents only a portion of wages and benefits paid while attending POST and is not for the cost of training provided by POST.The undersigned employee understands that POST may also require repayment of training expenses under a separate agreement between POST and the employee. COLLEGE OF SOUTHERN IDAHO (CSI) LAW ENFORCEMENT PROGRAM: If the City and Twin Falls Police Department hired the undersigned Employee and paid tuition for him/her to attend the College of Southern Idaho Law Enforcement Program and the Employee voluntarily leaves City employment within three(3)years of the Employee's graduation from CSI, the City should be reimbursed its investment. This reimbursement will include tuition paid while attending CSI. 4. SPECIALIZED TRAINING: In the event the undersigned employee voluntarily leaves employment with the Twin Falls Police Department within three(3)years of said employee's completion of any specialized training, the separated employee shall remit to the City the actual cost incurred for such training.
