HomeMy WebLinkAbout797 Pole Line Rd Permit File - PARIY WALL AGREEMENT THIS AGREEMENT is made and entered into this_:8- day of August, 1994,by and between White, White and Lawley, II, an Idaho general partnership, 702 Main Avenue North, Twin Falls, Idaho 83301, hereinafter referred to as "White," and Kalik Investors, an Idaho general partnership, 142 3rd Avenue North, Twin Falls, Idaho 83301, hereinafter referred to as "Kalik." WITNESSETH: WHEREAS, White is the owner of Lot 3, Block 1, except the west six and ninety one-hundredths(6.90)feet thereof,together with the west six and ninety one-hundreds(6.90) feet of Lot 4, Block 1, all in Amended Concept 91 Phase H Subdivision, Twin Falls County, Idaho (Parcel A), upon which it is constructing a commercial building ("White Building"); and WHEREAS, Kalik is the owner of Lot 4,Block 1, except the west six and ninety one- hundredths (6.90) feet thereof, of Amended Concept 91 Phase II Subdivision, Twin Falls County, Idaho (Parcel B), upon which it is constructing a commercial building ("Kalik Building"); and WHEREAS, in connection with the construction of the Kalik Building, a masonry wall, approximately eight (8) inches thick, was constructed on the western most eight (8) inches of Parcel B on a concrete footing situated in part on Parcel A and in part on Parcel B; and WHEREAS, the parties desire that said masonry wall be a party wall, to be used as the east wall of the White Building and the west wall of the Kalik Building; and WHEREAS, the parties further desire to set forth the terms and conditions under which said party wall may be jointly used and incorporated structurally into both the White Building and the Kalik Building; NOW,THEREFORE,the parties hereto,for themselves,their successors and assigns, to hereby agree as follows: , 1. The above-referenced masonry wall and footings shall constitute a party wall, and each of the parties hereto may use said wall jointly with the other, and said wall may be incorporated structurally into both the White Building and the Kalik Building, subject to the terms and conditions of this agreement. White hereby grants to Kalik such easements as may be necessary over, under, and across Parcel A, as may be reasonably necessary to retain said party wall and its footings in their present location, and to permit Kalik reasonable access to said wall and footings for the purpose of maintaining, repairing and using the same in connection with the Kalik Building. 3. Kalik hereby grants to White such easements as may be necessary over, under, and across Parcel B, as may be reasonably necessary to retain said party wall and its footings in their present location, and to permit White reasonable access to said wall and footings for the purpose of maintaining, repairing and using the same in connection with the White Building. 4. Said party wall and footings were constructed by Kalik, and in consideration of the right to use the wall, White shall pay to Kalik one-half of the costs incurred by Kalik in said construction. 5. Should the party wall or footings be damaged or destroyed by the negligence, or other act or omission of one of the parties hereto, such party shall promptly rebuilding or repair the same, and shall compensate the other party for any damages incurred as a result of such damage or destruction. Should the party wall or footings be damaged or destroyed by any cause other than the negligence, or other act or omission of either party, the wall shall be promptly repaired or rebuilt at the joint expense of the parties hereto, provided that any sum received from insurance against such damage or destruction shall first be applied to such repair or restoration. 6. The parties agree that in the event of a dispute or controversy as to any matter within or arising out of this agreement, or their respective use, maintenance repair, or replacement of the party wall, such dispute or controversy shall be submitted to the arbitration of three disinterested and competent persons, one of whom shall be appointed by White, one of whom shall be appointed by Kalik, and the third of whom shall be selected by the other two persons so appointed. Arbitration of the dispute or controversy shall not be binding on the parties hereto, but the opinion, by a majority of the three arbitrators, shall be a condition precedent to the commencement of any legal action over the dispute or controversy by either of the parties hereto. 7. This agreement shall be perpetual,and the covenants herein contained shall run with both parcels of real property hereinabove described, but this agreement, and the terms and conditions herein contained, shall not operate to convey to either party fee simple title to the land upon which the party wall, or its footings, are located. This instrument contains the entire agreement between the parties relating to the party wall rights herein created, and the obligations herein assumed, and any oral representation or modification concerning this instrument shall be of no force or effect. These comments are for the final plat. 1. Show a 20' utility and access easement along the westerly boundary. 2 . We may want to consider increasing the present 10' utility easement running along the northerly boundary to a 15' utility easement, this is to offset the 5' vacated for Comfort Inn. 3 . The 30' and 20, utility easement along the easterly boundary opposite Curve 1 do not have any curve data shown, I would assume these are curves. 4 . The written description on sheet two should match the plat shown on sheet one. 5. The concerns covered in my letter dated April 19, 1993 regarding the Costco plat also apply to this plat. These comments are for the revised preliminary plat. I. The proposed 6" water line along lots 2 , 3 , and 4 will need to have R.W. valves installed at each end. Is this line adequate Y� to serve the needs of a fire sprinkler system? 2. The proposed storm drain system through lot 3 will be underneath a structure. We would prefer not to have a building over this system. However, because this storm system is private then the developer and property owner will be responsible for this line. EHM Engineers April 20, 1993 Page 2 3 . The proposed sewer service line for lot 3 is unacceptable as shown. This line is shown running through a lot with different ownership. This would also apply to the telephone line shown. Should this be the location the sewer service is routed there will have to be recorded easements. Also, this may be in the �. area where the Comfort Inn plans on the constructing of a new building. 4 . The proposed 8" sewer service line for lot 2 should have a manhole installed in Fillmore. Also, this line can be extended to the east to service lot 3 , rather than crossing Comfort Inn's property. This will require a manhole at the angle point and a manhole at the end of the 8" line. This line can be located in the utility easement running along the north boundary. f45. In reviewing the plats for Concept 91 Phase there is no easement shown for the storm drain system running across lot r 1. This plat does not show any easements for this storm drain. This should be addressed as this crossing across Comfort Inn's property may be in conflict when a new building is built. 6. our office is still waiting on the agreement regarding the proposed park along the easterly edge of the property. In talking with LaMar he sees no problem in allowing the use of this 20' landscape easement for parking in exchange for the r development of the park. 5 7 . There needs to be a sediment basin for this storm drain system where the two systems come together with the one from the State Farm property. The storm drain line running behind lot ,e 3 to the east will also need a sediment basin. 8 . I will need the documentation regarding the discharge permits, drainage calculations, and any other information pertaining to this project. I believe. each project should have it's own information in the file rather than searching through several files to find the needed information. I would appreciate additional copies of this information for this project and the Costco project. 9 . Gary Young and I reviewed the proposed storm drain routing and think there is the possibility of improving the existing stoom drain route and reducing the total pipe needed to construct this system. Check with our office on this. 10. The location of the proposed building on lot 4 will create a traffic hazard for southbound traffic using the access along the east side of the building. The southeast corner will be limit the sight distance for motorist southbound looking to the west. 11. There should be a minimum 10 ' seperation between water lines and storm drain lines. 12. Please note, 79% of Costco's square was rated as store space. Only 10% was rated as warehouse. The labeling of floor area for use and square footage is the responsibility of the architect. You will recognize that the actual breakdown of floor area is different than reported at the Council meeting. At the meeting Jim Leichliter reported, incorrectly, that most of the floor area was designated as "warehouse". I believe the balance of the table is self-explanatory. If you have any questions, please do not hesitate to call. 2. Delays in Issuance of the Building Permit There appears to be two issues that caused the delay in processing your application. First, there was some difficulty getting an accurate site plan and lot description. This may seem like a small point; but, unfortunately; we are unable to determine setbacks, location of easement, allowable building size, etc., without accurate property lines. The site plan is the responsibility of either your engineer or architect. Second, we did not receive a soil report until very �i Rick White January 28, 1993 Page 2 late in the process. The soil report is critical to determine if the footing design is adequate. According to our records, we allowed EHM to use the soil report they prepared for Costco so that we could avoid further delays on your project. The request by EHM was made in early December 1992. Our objective is to process permits as quickly as possible. We do not like being in a position where we are seen as an obstacle to development in our community. We are working to change this image. We have retained Dawneen Blakeslee to train employees in customer satisfaction skills. We are also streamlining procedures to minimize time delays. Timely reviews are largely dependent on the quality of the submittals from design professionals. Inadequate submittals cause time delays. We are frequently blamed of these delays. Our turnaround time is usually held to a minimum when the initial submittal from the architect or engineer is complete. 3. Aooeal Procedure We are developing an appeal procedure for building valuation. It is being written by our attorney and will be reviewed by the Council in several weeks. The procedures gives the owner the option of appealing the valuation by submitting an appraisal of the finished project. I discussed this concept with Doug Vollmer. He indicated most lending institutions are requiring appraisals based on the building plans which are updated upon completion of the project. If the owner is financing the project, then he should be able to use the appraisal required by the lending institution to appeal the permit valuation. Consequently, our appeal process should not be a major cost to the owner. It will also minimize the time required by City staff to review appeal documents submitted by the owners. Rick, I realize you have a busy schedule and may not have time to meet on these issues. As we discussed, your questions and concerns are important.
