The application and case would be for you to determine and argue for yourself. Staff’s role would be to talk about potential impacts and be the third-party unbiased reviewer of the application. If you believe the application would satisfy all of the criteria for review, then apply and make your case. Please note the Planning and Zoning commission would need to find all the criteria of review to be in your favor. This is why variances are hard to get (at least in theory or for staff to fully support).The criteria that we would review for is as follows (See the following link): a) That special conditions and circumstances exist which are peculiar to the land, structure or building involved and which are not applicable to other lands, structures or buildings in the same district. b) That a literal interpretation of the provisions of this title would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of this title. c) That special conditions and circumstances do not result from the actions of the applicant. 1 d) That granting the variance requested will not confer on the applicant any special privilege that is denied by this title to other lands, structures or buildings in the same district. e) That a literal enforcement of the provisions of this title would result in unnecessary hardship. For purposes of this section, where a reasonable conforming use is, or can be, located on a lot or parcel, there is no unnecessary hardship. That being said there could be a case to accomplish a variance for the centerline setback and have it go to the normal front yard setback. I believe that would be the only option for a variance though and still would need to think about and review for whether or not it would constitute a deprivation of a right associated with that zone. At this present time my thought would be Staff would be relatively silent on a recommendation of support or denial. As for your question regarding a regular residential home being built on the property, a single family detached would be allowed in this zone. Let me know if that is something that is possible. otherwise it does make a 3 potentially great lot nearly unusable and an eye sore for the area. The neighbor to the west is about 43- 45' setback and neighbor to east around 54 feet. side note: alternatively, is there anything that would prohibit the lot from being used to just park equipment/trailers/etc if building on it is really not going to work out. Can you tell me distance of centerline to edge of property? Also is there a way to get an exception to that setback by showing properties both to the east and west are closer than that as well as many other homes along this corridor on this South side of Addison. And I do understand they would be grandfathered in. I show the offset of 20' off Addison actually put the building envelope further back on the lot than the neighboring parcels.
