Thank You… My son was having sex with his girlfriend in his room, everyone in our house knew this because we're all sick of it, there were 5 others in the house that night when this happened. This girl Anna Avakova is psychotic, controlling, and vindictive in a manner that is so over the top it's hard to believe, everyone knows it. My sons life has been stolen from us based on her words alone. A rape kit proves nothing, it was the weekend he was home from work from Boise, all they do when hes home is have sex and watch movies and argue. She said he raped her but he did not, she said he choked her yet when Heather and I were in his room, she said nothing, we were present Ruth, we even warned both of them STOP ARGUING or were calling the police. 2 trips we made to his room to tell them to shut up before we called the police. I had my ear at the door Ruth. My wife had moved out once already and lived in an apartment over his sex in our home. I had my ear at the door because I wanted to protect my wife from even knowing. 1 Anna is a liar Ruth. A psychotic liar void of any emotion. She may even be a psychopath. She was in bed with him in his Hotel the next morning. Heather Fox at Motel 6 told me when I tried to get surveillance, that she did not have surveillance any longer but told me that Anna tried to get a key to Tommy's room, when Heather Fox at Motel 6 told her she could not have a key, Anna said.. "No one can know I was here" My son tried to call her from jail and got 27 felonies pending because he just wanted to ask her why? He loved her so much Ruth. Those felonies caused us to take a deal rather than face 90 years in prison. Please help Ruth. She told us MONTHS before this happened “That girl is going to put him in prison!” those were her exact words. Anna is psychotic Ruth. Ruth, my son is a lot of things but he's never been violent. Ruth my son could die, he almost did last week when Cedric Mithcell tried to kill him, my son needs help Ruth. Cedirc Mitchell tried to murder him, but the jail told him if he presses charges hes going to get into trouble himself so hes not. They call him “Rapo” in the jail, and now they also call him a “snitch” even though hes not pressing charges. His life is in danger. He lays on the ground all day and looks at the ceiling Ruth. I don’t believe my son will survive Ruth. Hes going to go into this prison system a “Rapo” and a “Snitch” everyone in the jail hates him Ruth. Everyone. Even the guards hate my son. He asked me to pray for him to just find 1 friend. God has yet to answer that prayer. Ruth, my son is innocent. A simple investigation would have proven that. 2 Ruth, please help my son before he is killed. He’s already crazy, he’ll never be the same again Ruth, but please don’t let my son die in jail Ruth please. I beg you to help me Ruth. I have so much respect for the TFPD I have attended more than one graduation ceremony. I have helped Clint Doerr bust a couple meth people, I know Liz Guman, Barnhardt and so many others in the department so well. I’ve never met Samir Smriko til that night. We strongly supported this community and the officers in the community, we pray for them. My wife stayed at Mike Wendler's home and cared for his children for a month so his wife could be with him in Pocatello while he recovered. We have been pillars to all the officers in this community. I tried to help save a young boys life on the bridge a couple of months ago who jumped and died right in front of us. Ruth we are good people and have supported this community since we arrived here 21 years ago. I know Scott Bishop, Tom Carter these guys are my friends. We deserved a decent investigation Ruth. My son deserved at least some questions asked on his behalf. But none were asked of ANYONE. My wife and I are the ones who called the police, yet no one ever reached out to us. Not 1 person, investigator or otherwise. Ruth they messed up bad Ruth and now my son may die. You may think I'm being dramatic but I'm not Ruth. Please help me. Please Ruth. I beg you. On Jan 11th (3 months after he was arrested) Anna called me and asked me to help her with her Resume, she came to my home sat next to me for 1 hour and I made her resume. On Jan. 14th she filed a restraining order against Tommy and said she was afraid of me. (I can prove this) Officer Smriko told Anna “Oh we know who Tommy is and this is a long time coming” When Anna tried to do the right thing and have the charges dropped the district attorney flipped her by telling her “He has done this to other girls” (He has not Ruth, he has no violent history at all.) Tommy had bought her an engagement ring online before he was arrested, when she got it she wore it for weeks posting pics that said “I said yes” (So crazy Ruth) Ruth there is so much more I can tell you, so many witnesses that needed to be talked too. Also Ruth Tommy was never warned with those additional 27 felonies, had he got 1 or been warned that the communication he was doing was wrong he would have stopped, I was culpable there I was trying to ease his pain that was so severe. We are still in shock over this. 3 Instead they dumped 27 felonies on him at once. So he took a deal. Domestic Violence Felony and Intimidating a witness felony. He will be sentenced on May 1st. Ruth this could happen to anyone, it's not fair Ruth. This could be your son Ruth. Please don’t stand idly by Ruth. Please help this father. Sincerely, Mark Deaton 208-404-8157 PS: I believe Ruth that my son's comment that “He was going to kill himself” may be why no one ever investigated on his behalf, they wrongly interpreted that as an admission of guilt, and that could not be further from the truth… He told his mom and I “If you call the cops I'm going to jail..”If you call the copy I'll kill myself” he said that because he had court in Canyon county and jerome county that same week, and he knew that ANY interaction with the police AT ALL would put him in jail. He knew he was going to jail if the police came. Thats why he said it, and I believe they interpreted that as guilt. If they had questioned us like they should have, we could have explained Ruth, but they never asked us anything at all. They just charged him and never reached out to anyone that was present, not even mom and dad who were involved in every moment of that evening. Ruth I beg you to help us save my sons life. A few years later I saw a friend being attacked verbally online. Anna was tearing her apart for how her hair had turned out. When I stood up for my hairstylist friend by 4 explaining to Anna what the technique is, as I am a cosmetologist myself, she lashed out at me and called me an old ugly bitch.
