I believe the following information rebuts Mr Roots claims listed in Paragraphs 3 and 4 of his email.

Therefore, the fire training location is only accessible by vehicle, and per the 2010 Standards for Titles II and III Facilities:
2004 ADAAG - Chapter 2 Section 206.2.1 Ex. 2 :
…“An accessible route shall not be required between site arrival points and the building or facility
entrance if the only means of access between them is a vehicular way not providing pedestrian
access.”…
Confirming what Sam already shared below: Victory Ave does not have sidewalks installed as it is located within an M2
Zoning District (Per City Code 10-11-5-B-1-a.).

I will respond to the items covering accessibility requirements/concerns by Mr. Root…
An accessible route has been provided from the building entrance to the right of way via the asphalt
driveway. The code does not require a sidewalk to serve as the accessible route.
Per IBC section 1111.1(1) Where the total number of parking spaces provided is 4 or less, identification of
accessible parking spaces is not required. The space has to be provided, but not marked.
Pg. C2.01 shows the correct width of the parking stall (if it were required to be marked). Yes, we do have an
incorrect detail 10 pg. C2.50. I reached out last night to Clint Sievers with Pivot North and he is looping in
Tad and Eric from the Landgroup for a resolution. Per code, the signage is not required, but the signage
should be code compliant if provided. I have asked for a revision to the striping and the wall sign.
The ICC A117.1-2009 code section 502.4 only requires the access isle to be located on the passenger side
when the parking spaces are angled.
Sheets C2.02 and L1.00 are not included in the drawing index.

Good Morning All,
Just some notes for the items provided in the previous emails.
The 11’ parking stall with 5’ unloading zone is acceptable. Per our ADA training course, the
vehicle can be backed in.

This property is in the M2 zone (manufacturing zone). The M2 zone does not mandate
sidewalk, only curb and gutter.
Since no sidewalk is required in the M2 zone, there is not a route to guide a pedestrian to for a
long distance. So I am unsure how an accessible route to the right-of-way would be beneficial
here.
Typically, the accessible parking space is reviewed by building when they look for the
accessible route to the building.
o The conflicting detail on the civil sheets was not caught. The 9’ should be 11’ to be ADA
compliant. The layout is acceptable either way.

Council,
On the agenda for tonight is a vote on the fire training facility.
After a cursory review of the approved City plans, I have concerns
regarding Accessibility and compliance with Federal Laws and City
Codes. Please ensure there is somebody at the City that is designated
for ensuring City-constructed facilities meet all Federal, State, and
Local laws regarding Accessibility.
For example, The Architectural Sheets show a Van-Accessible parking
space with an access aisle on the passenger side. The Civil Sheets
show a Non-Van-Accessible parking space with an access aisle on the
driver side. The Architectural sheets describe the space as "Disabled
Parking" which is in conflict with language in the Idaho State code.
Neither sheet provides for signage on a post easily visible at the
front of the space, neither sheet specifies the mounting height, and
the City should carefully review whether signage on the building face
as prescribed by Drawings is compliant with federal code and
recognized best practices. It is also not clear that the appropriate
number of accessible spaces will be provided.
Additionally, it is not clear that there is an accessible egress path
to the public right-of-way per the Americans with Disabilities Act,
since no sidewalk is shown from the building to Victory Road and
pavement cross slopes to the gate exceed 2.08%.
Additionally, The Landscaping sheets for the entrance do not show a
sidewalk on Victory Road frontage as required by TF Code for a typical

street section.
Sheets C2.02 and L1.00 are missing from the Approved drawing set.
The Council may wish to postpone approval of this project until the
Council can be assured that the project is in conformance with
Federal, State, and Local codes.
