Such form shall contain the definition of"harmful to minors,"as provided in section 18-1514, Idaho Code."As this is a confusing and imprecise code and whereas these individual forms produced by the many libraries in Idaho may or not be in full accordance with the "requirements" not fully delineated or explained by the legislature and whereas the definition of"harmful to minors" is in Idaho Code there is no reason to repeat it in these requests other than if the request comports with what Code defines as obscene. If this request is not complied with for the reasons set forth then Code actions are required to be followed by I.C. 18-1517B(5)A county prosecuting attorney or the attorney general shall have a cause of action for injunctive relief against any school or public library that violates the provision of subsection (2) of this section. The injunction shall be sufficient to prevent the defendant school or public library from violating the requirements of this section. In addition as there is nothing in Code denying a citizen to submit their own request form and since there is no requirement for follow up in Court by the citizen but Code seems to suggest the prosecutor or attorney general "shall have a cause of action"then they have the burden to pursue each and every citizen request or dismiss same. Please note that the applicable code also does not require any information revealing the identification of the requester these requests could be made anonymously if the citizen so desired though this assertion may have to be adjudicated in court. Reason for the review: There are sections that comply with pertinent Idaho Code 18-1514(3)such as Leviticus 18:22 and Genesis 13:12 and 19:29.A plain reading of these sections of the Bible is enough to fulfill the obligations set forth by the Legislature as obscene. If a prosecutor or attorney general cannot see the obvious,they should be supplied with my email address and I will explain further.
