Mailing Address: 464 Carriage Lane n City, State Twin Falls ID Zip 83301 Comments: 11/1/10 Amber observed sign at church 11/3/10 Amber verified sign did not have permit 11/4/10 Amber sent courtesy letter with compliance deadline of 11/12/10 I 11/12/10 sign down I I12/9/10 Letter sent about permanent free-standing signs as no permits are on file. 12/20/10 Robert Powers came in on behalf of the Our Savior Lutheran Church and asked about the letter. Since the signs were up before the code changed in 2008 he didn't think that the City could request compliance with the current code. Amber clarified that "grandfathering" only applies if the signs were established legally. They were not put up with permits legally and so they don't have any rights under any code. He said that the signs were approved with the building plans and I told him that is not i the procedure but I would check the plans and see if I could find out if there was something else i considered in this case. This new room has been framed in the same manner, and using the same truss design and construction details as the originally-designed mechanical room ARCHITECT-LA Pc above Corridor 105.The new room contains one furnace unit, weighing approximately 300 lbs, located in the SW corner of the space. This new space is accessed by a 43 1/2" by 32" floor hatch near the NE corner, which complies with the code requirement of being sufficient size for the removal of the largest piece of mechanical equipment. In order to construct the access hatch, one truss was modified by cutting the bottom chord. Since the trusses were a design-build item, this modification will have to be approved by the truss designer. The construction cost, engineering, and inspection cost a total of$103,944. The total sewer length was 4,452 linear feet for a cost per linear foot of$23.35. The Our Savior Lutheran Church is obligated to pay 3200 Developers,LLC,one-half or$11.67 per linear foot for their frontage on Carriage Lane, which is 550 linear feet. Therefore, the church owes 3200 Developers, LLC a total of $6,420.62 which should have been paid prior to starting construction and now needs to paid as soon as possible. Applicant has applied for a Special Use Permit to construct and operate a religious facility on approximately 7 acres located at the southeast corner of Filer Avenue East extended and Carriage Lane extended within the City of Twin Falls' Area of Impact. 2. All legal requirements for notice of public hearing have been met with advertisement taking place on the following date: May 11, 2000. 3. The property in question is zoned R-2 PUD within the City's Area of Impact pursuant to the Zoning Ordinance of the City of Twin Falls. The property is designated as urban residential in the duly adopted Comprehensive Plan of the City of Twin Falls.- 4. Relevant criteria and standards for consideration of this application are set forth in Sections 10-1-4, 10-1-5, 10-4-4.2(B)5b, 10-7-6, 10-9-2(R), 10-10-3, 10-13-2.2, Twin Falls City Code. 5. The existing neighboring land uses in the immediate area of this property are: to the north, Filer Avenue East extended/ undeveloped residential; to the south, agricultural; to the east, agricultural; to the west, Carriage Lane extended/developing Woodland Hills Subdivision . 6. The proposed use is consistent with the purpose of the R-2 PUD Zone and would not be detrimental to any outright permitted uses or existing special uses. 7. Any detrimental effects on the neighborhood would be ameliorated by observance of the conditions which are attached as "Exhibit No. A", and incorporated by reference as though fully set forth herein. 8. Developers, Owners, and their assigns or successors in interest, as weU as City and its assigns and successors ('if any), shall be bound by the terms and conditions contained herein. 2 NATUgE OF TgE DFVELOPMENT. It is agreed by the parties hereto that certain language and requirements pertaining to the "C-1, R-2, R-4 &R-4(PRO) PUD" zone shall be interpreted as follows: -2 - • r A. USU, The use language in the Twin Falls City Code, Title 10, regarding the underlying "C-1, R-2, R-4 & R-4(PRO) PUD" zone shall apply with regard to permitted uses, special uses, and prohibited uses on the Property or any portion thereof as shown on the Master Plan. B. Developers shall be permitted to develop the Property in phases, provided those phases are in compliance with the Master Plan, this PUD Agreement, and an approved preliminary plat. Approval for each phase may be obtained by submission of a technically correct final plat for each phase to the City Council. The designation and location of specific uses, and buildings on the Master Plan are conceptual and minor changes therefrom shall not provide basis for disapproval of any final plat. There shall be no minimum and a maximum time limit of three years between completion of one phase and commencement of the next phase. 3. STREET, SEWER, WATER Developers shall be responsible for the design and construction of street, sewer, water and drainage systems on the Property (hereinafter "Improvements") as descnbed herein in accordance with City standards. A. EWPROVEMTENT PLANS. Developers shall, as to each phase of its development, file or cause to be filed with the City a complete set of plans for that deJelopment phase, showing all Improvements contemplated within that phase of the development (hereinafter -3 - "Improvement Plans"). The improvement Plans and all improvements shown thereon shall meet with the approval of the City, which approval shall be given if such plans conform with published City requirements. B. . Developers shall cause to be designed, constructed and installed, in accordance with the Improvement Plans and at its expense, all Improvements shown on the Improvement Plans. Notwithstanding the foregoing, nothing in this Agreement shall prohibit City participation in the cost or financing of improvements on the Property if mutually agreed to by the parties hereto. C. pAA cED CONs'T gjjCTEQN. Developers may 'install the improvements all at once or in phases. Developers shall provide the City with written notification of which phase it intends to develop, when and of what portion, or portions, of said improvements it intends to complete at the time; and agree to make such modifications and/or construct any temporary facilities necessitated by such phased construction work as shall be required and approved by the City, which approval shall not be unreasonably withheld. Y D. SUPERVISION. Developers shall use a qualified ' construction engineer or supervisor to supervise the construction inspection and testing of the work as necessary, to ensure that all such Improvements are constructed in accordance with the approved Improvement Plans. -4 - E. NQNrQMMLTANCE. In the event any of the requirements with regard to the installation of said Improvements are not complied with,the City shall give written notice to Developers of said non-compliance. Developers shall cure said non-compliance within thirty (30) days of this receipt of notice (or, in the case of non-compliance that will take in excess of thirty(30) days to cure, Developers shall commence to cure within thirty (30) of receipt of notice and diligently pursue the same to completion). In the event Developers fail to cure said non- compliance in the manner set forth hereinabove, the City shall have the right to withhold the issuance of any future building permits and certificates of occupancy within that phase of such "PUD" until such time as all requirements specified in Section 3 have been complied with, PROVIDED, HOWEVER, Developers shall have the right to appear before the City Council at any regular meeting after any building permits and certificates of occupancy shall have been withheld for reasons set forth in this paragraph, and shall have the right to be heard as to why such building permits and certificates of occupancy should be issued. The City Council shall then in good faith and in an objective manner decide whether said building permits and certificates of occupancy should be issued, and its decision shall be final, except that the rights of the parties are preserved at law and equity. F. FEES. Developers shall pay, or cause to be paid, to City all applicable fees, if any, with regard to the installation of improvements pursuant to the improvement flans. P .AT . Developers agree to file with City a preliminary plat, prepared by a registered professional engineer, of the real property which is the subject of this Agreement. Final plats for phases to be developed shall be submitted specifically identifying and dedication all necessary public easements and those rights-of-way the City agrees to accept herein and in the Standard Developers Agreement. It is agreed that said plats and any amendments thereto must first be approved by City. 5 . The Property or any portion thereof shall be developed in accordance with criteria set forth in this Section 5. A_ AppgOVAL ANp CoNsTRUCTION. All Improvements shall be constructed in accordance with engineered drawings and specifications, describing in reasonable detail the work to be performed, which drawings and specifications shall first be approved by City and meet City standards, which approval shall not be unreasonably withheld. DRAINAGE. (1) Storm water from commercial developments shall be retained. Facilities to retain storm water shall be designed, constructed, and maintained by the property owner of each lot in the development, unless specific written arrangements are made to share those responsibilities among several lot owners and/or the City. (2) Storm water from residential developments shall be detained to limit discharge to downstream drainways. Detention facilities mereting City Code requirements in effect at the time of plat approval shall be designed and constructed by the Developers, and -7 - maintained by the property owners' association of each development, unless specific written arrangements are made to share those responsibilities among individual lot owners and/or the City. E. Buildings and Improvements shall comply with the following standards. (1) Prohibited Metal sided buildings and buildings with exposed unpainted plain concrete block are prohibited. Concrete tilt-up or double-T panels are prohibited unless they have a decorative finish. This does not preclude the use of decorative masonry block or brick or the use of architectural residential metal siding. The commercial buildings are to have pitched roofs and facades broken up with windows, awnings and building recesses. Commercial building colors are to be low reflectance, subtle, neutral or earth tone colors. The use of high intensity colors, metallic colors, black or fluorescent colors is prohibited. Neon tubing is not allowed as an accent material. It is understood and agreed by the parties hereto that it shall be necessary for Developers or individual owners to execute the City's Standard Developers' Agreements. 9. GRYERAI, PROVISIONS- A. .COOPERATION. The parties hereto agree to cooperate each with the other. Developers shall submit to the City all plans, specifications, and working drawings required by the City. B. . This Agreement constitutes the entire ` agreement between the parties concerning the property and improvements described herein, and no amendment or modification to this Agreement shall be valid or effective unless reduced to - 10 - writing and signed by the parties. Should any provision of this Agreement require judicial interpretation, the Court interpreting or construing the same shall not apply a presumption that the terms hereof shall be more strictly construed against one party, by reason of the rule of construction that a document is to be construed more strictly against the person who himself or through his agents prepared the same, it being acknowledged that both parties have participated in the preparation hereof. K. AIJACEDENIS. All attachments to this Agreement and recitals are incorporated herein and made a part hereof as if set forth in full. L. rALOONS. The church will generate considerable traffic to the area at certain times, primarily on Sunday. That impact will be no more than that experienced in other residential areas with churches in them. The City receives very few complaints about churches in residential zones. The site plan appears to be well thought out. There are pedestrian walkways through the parking lots, landscaping exceeds the code requirements, parking exceeds code requirements, setbacks are met and there is only one access off both Carriage Lane and Filer Avenue East. The site plan does not show storm water retention, but it is addressed in the narrative. If the 'future building' will not be built for 10 years, it will require a special use permit at that time, unless this permit request is approved specifically allowing the future building without an additional special use permit. The narrative states that the additional building will be used "in the future for outreach ministries and other church related functions." There should be clarification of what those functions are. Any signing for the site will have to comply with City code section 10-9-2(R) and will take Commission approval. The site will have to be platted prior to any building permits being issued. The preliminary plat is scheduled as Item #13 on this agenda. Issues relative to Filer Ave E dedication and development of Filer Ave E and Carriage Lane need to be addressed. The Phase 1 portion of our new church facility is designed for multi-functional use. In addition to worship and fellowship after service, it will have rooms for Sunday School and ministry group purposes_ However, it is important to note that during worship the rooms, other than the nursery,will not be used concurrently. The capacity of the worship area is estimated to seat 200 persons. A historical evaluation of our average worship attendance may be useful to you. Our Savior Lutheran average worship attendance was 1998-143 (2 services); 1999-122; 2000-N.A.; 2001-115; and 2002-109,year and attendance, respectively. Our projected average worship attendance is estimated for 2003-110; 2004-118; 2005-122; 2006-125; 2007-128; and 2008-130, year and attendance, respectively. On those occasions where greater attendance is anticipated the fellowship area could be utilized as well. We anticipate this would only occur with some weddings or funerals, for example. Our building program is the culmination of a long-term vision to construct a facility that allows the congregation to enhance our outreach and ministry currently constricted in our present location. The phase 1 is a portion of a 3-phase vision that will eventually see the construction of a long-term sanctuary and a second fellowship wing. However,the total site is graded and seeded with lawn and an irrigation system installed The parking lot for the total facility is complete in terms of grading, gravel and compaction. It is our understanding that we will be required to install paved parking for 50 parking spaces. We are currently working on the most functional layout to best meet our needs for parking. The proposed development consists of building a new 25,460 square foot church building and parking lot on approximately 7 acres which is within the Cedar Park Planned Unit Development, R-2 zone. A church is allowed within an R-2 zone with a special use permit, which is being applied for concurrently with the preliminary plat. An additional 13,500 square foot building is proposed in the future for outreach ministries and other church related functions. Construction of the additional building would be at least ten years in the future. The proposed project will be compatible with surrounding uses. The property to the west of Carriage Lane is platted for single family residential lots under the Woodland Hills Subdivision, which is scheduled to be developed soon. The property to the south and east is currently being used for agricultural uses and it is also part of the Cedar Park PUD and will be developed for uses allowed in the R-2, PUD zone. The parcel to the north of the proposed development is zoned R-1 Variable and it currently has one single family residence located on it. Churches are historically good neighbors to residential uses. UTILITIES The development will be serviced with City of Twin Falls sewer and water and underground power, telephone, gas and television. Although the utilities are not adjacent to the property at this time, the sellers of the property have committed to bringing the required utilities to the property with development of adjacent residential property. The property has five shares of Twin Falls Canal Company water. It is the intent of the developers to connect into the regional pressurized irrigation system to irrigate the landscaped areas. STREETS The east half of Carriage Lane North and the south half of Filer Avenue East will be dedicated to the City of Twin Falls and constructed as collector streets under the proposed development. The existing end of Carriage Lane is a few hundred feet south of the south property line of the proposed development. The sellers of the property have agreed to construct Carriage Lane to the southern parcel boundary prior to May 1, 2001, 444-004.%pa which is the earliest time which Our Savior Lutheran Church would break ground. Carriage Lane North would be constructed to centerline along the subdivision. The right of way for Filer Avenue west of Carriage Lane has been dedicated under the Woodland Hills Subdivision and will be constructed by the Woodland Hills developer when the subdivision is developed. It is requested that Filer Avenue East will be constructed to centerline along the north property he of the proposed subdivision when adjacent development of Filer Avenue East is completed. A deferral agreement is requested for the construction of the curb, gutter, sidewalk and street until such a time as adjacent development takes place. Carriage Lane North will be the primary access to the development until Filer Avenue East, in the Woodland Hills Subdivision, is developed. Carriage Lane is designated as a major collector street and has the capacity to handle the anticipated traffic generated from the proposed development. Traffic demand from a church facility is typically at off peak hours and days, which creates less impacts on traffic needs. DRAINAGE Additional stormwater runoff generated from the subdivision will be detained on site in the landscaping areas as shown on the site plan. The detention areas will be graded as shallow swales, 2 to 2.5 feet in depth. In addition to detaining the stormwater generated on site, the stormwater facilities on site will also detain stormwater runoff currently detained on the site which is generated from previous developments of Cedar Park Subdivision. Stormwater calculations are enclosed. The stormwater areas will be landscaped with trees, lawn and possibly rock landscaping. The proposed system will provide storage and treatment of the stormwater before entering Perrine Coulee#1 at a metered predeveloped rate. Grassy swales is an effective filtering device to remove oils and heavy metals in the stormwater which are typically found in urban stormwater runoff. FLOOD PLAIN STUDY A flood plain study was performed to determine the approximate100 year flood plain boundary of Perrine Coulee #1 within the proposed subdivision. The study reveals that the flood boundary is approximately an area forty foot by eighty foot located in the northeast corner of the property. The area subject to flooding will not have any permanent buildings or stormwater detention facilities constructed within the boundaries. The flood plain study calculations are enclosed. LANDSCAPING The required area of landscaping by City Code is 26,745 square feet or 100/6 of the lot area. The development provides for over 120,000 square feet of landscaping after-3?�" the future building and parking lot are constructed, which is over four times more than the 444 004.wpd 2 required amount. Landscaping will consist of various grass, trees,bushes and possibly some rock landscaping. Play areas may be incorporated area within the site landscaping. BUILDING AND USE The proposed building will primarily be built with masonry products. Typical building elevations and the preliminary floor plan are enclosed. The building and its uses will not create noise, glare, odor, fumes or vibrations. There may be some temporary dust, equipment noise and vibration associated with general construction practices, but the inconveniences will be temporary during the development of the property. There will be one full time employee and three part time employees working during normal hours of operation between 8:00 a.m. to 5.00 p.m. Monday through Friday. Worship services are scheduled for Sunday morning and there are occasional evening functions. SIGNING Signs are proposed along Carriage Lane and Filer Avenue at the approximate locations shown on the site plan. The signs will be in accordance with Title 10-9-9,C of the City of Twin Falls Code. PARKING The proposed development layout provides for 177 parking spaces in the initial phase of construction and 195 spaces in the future expansion. The Twin Falls City Code requires one parking space for every four seats or eight feet of pew in the main auditorium. The proposed sanctuary will seat 300 to 350 people, which requires 75 to 90 parking spaces. The number of proposed parking lot spaces will meet City Code and provide abundant parking for larger special events. The development will provide easy access to these spaces with two way access roads onto Filer Avenue and Carriage Lane. Landscaped islands are located throughout the parking lot to provide an aesthetically pleasing appearance. Parking lot lighting will be installed primarily in areas close to the church building for safety. Garbage facilities will be located in an enclosure on the east side of the parking lot. PROJECT DEVELOPMENT The development will be completed in two phases. The public improvements, construction of/2 Carnage Lane, the parking lot, building and landscaping will be constructed concurrently. Construction on the initial phase will most likely start in the spring or summer of 2001. Construction of Filer Avenue East will be at the time of adjacent development of Filer Avenue.
