I spoke with Jon Victor, Building Plans Examiner about your question regarding selling
items online. Planning and Zoning does not regulate online sales businesses unless it
is in a residential area and the customers are coming to the neighborhood to pick up
their items and most likely this would be initiated by a complaint from a neighbor.
However, Jon did state that if you would like to sell the items online and the

customers pick up the items at 163 3 Ave W that would be allowed under the B-
occupancy in the front office area of the building. He also stated that if the special use
permit is approved and you are able to operate the gym from this location if you are
going to display some of these items and sell them from the front office area it should
not be an issue, your items are very specific to the business and it would not be
looked at as a mercantile (retail) type use. There is an occupancy for the front office
area of the building already established as a B-Occupancy so if you wish to advertise
and sell your gym swag online with people coming to the location to pick up their
items that would be allowed.

Thank you for your email. We were using a scissor lift today to paint and the floors are
being installed in the front which is noisy today. I apologize for the noise.
I understand the importance of not using the space as a gym at all.
The shipment for equipment is coming in Friday between 1-3pm.
I have an appointment with Colby tomorrow morning to get you the information you
need.

Becky,
I wanted to let you know I have received several emails from
Shawnee at Float Magic regarding the noise and vibrations
concerns she has with the proposes gym.
What I wanted to reiterate is that the building cannot be
used as a gym until you have received approval of the
Special Use Permit and you have received a Certificate of
Occupancy form the building department. This means neither
you or anyone else should be in the building training or using
the space as a gym. In the past, we have had applicants
admit to the commission that the neighbors did witness them
using the building prior to approval of the SUP and it did not
go well for the applicant.
I did let Shawnee know that there will be some activity in the
building while you have equipment delivered and required
improvements that will need to be completed once you have
a building permit. I want her to understand this will impact
her business for a minimal amount of time while these things
are getting completed.
Please be mindful of these concerns and understand that the
commission may take them into account when making their
decision to approve the special use permit, add conditions to
the permit or even deny the permit. I highly recommend that
you work with the architect and that you have a viable plan
for mitigating the noise and vibrations so that we can move
forward through the process with a positive outcome.
