Prior to opening the first Public Hearing of the session,the Mayor or Chair shall review the public hearing procedures. 2. Individuals wishing to testify or speak before the City Council or Planning & Zoning Commission shall wait to be recognized by the Mayor or Chair, approach the microphone/podium, state their name, and then proceed with their comments. Following their statements,they shall write their name and address on the record sheet(s)provided by the staff. The staff shall make an audio recording of the Public Hearing. 3. A City Staff Report shall summarize the application and history of the request. 4. The Applicant, or the spokesperson for the Applicant, will make a presentation on the application/request (request). No changes to the request may be made by the applicant after the publication of the Notice of Public Hearing. The presentation should include the following: • A complete explanation and description of the request. • Why the request is being made. • Location of the Property. • Impacts on the surrounding properties and efforts to mitigate those impacts. S. Applicant is limited to 15 minutes,unless a written request for additional time is received,at least 72 hours prior to the hearing,and granted by the Mayor or Chairman. 6. The City Council or Planning&Zoning Commission may ask questions of staff or the applicant pertaining to the request. 7. The general public will then be given the opportunity to provide their testimony regarding the request. The Mayor or Chair may limit public testimony to no less than two(2) minutes per person. • Individuals are not permitted to give their time to other speakers. • However, five (5) or more individuals that received written notice of the public hearing may appoint, by written petition, a spokesperson. The written petition must be received at least 72 hours prior to the hearing and must be granted by the Mayor or Chair. The spokesperson shall be limited to 15 minutes. • Written comments,including e-mail,received by 12:00 p.m.on the date of the hearing shall be either read into the record or displayed to the public on the overhead projector. 8. Following the Public Testimony,the applicant is permitted five(5) minutes to respond. 9. Following the Public Testimony and Applicant's response,Council or Commission members,as recognized by the Mayor or Chair, shall be allowed to question the Applicant, Staff or anyone who has testified. Approved 5 to 0 4) Items of Consideration 5) Public Hearings a) Request for a recommendation to City Council to amend the St Lukes PUD, adding multiple land uses, and modifying the Master Plan layout on property located at 801 Pole Line Rd West. c/o Curtis Weedop on behalf of Rick Stewart (PZ24-0020) Staff Presentation: Senior Planner Klaver presented the request for a recommendation to City Council to amend the St Lukes PUD, adding multiple land uses, and modifying the Master Plan layout on property located at 801 Pole Line Rd West. c/o Curtis Weedop on behalf of Rick Stewart (PZ24-0020) Per City Code 10-6-1.7 (B) The applicant is required to present a preliminary review prior to a public hearing to the Planning and Zoning Commission in which the Commission may give suggestions and ask questions of the applicant about the proposed ZDA. Per City Code 10-6-1.7(E) Approval of a ZDA shall be based on the following standards: the proposed uses are not detrimental to surrounding properties; deviations from Title 10 shall be warranted by the design of the conceptual plan; conformance to the Comprehensive Plan, and existing and/or proposed infrastructure must be adequate for the project. Per City Code 10-14-1 thru 8 Any application for a zoning district change shall follow the procedures outlined in these sections. St. Luke's PUD was created in late 2007. This agreement expressly stated that "buildings, structures or premises shall be used and buildings and structures shall hereafter be erected, altered or enlarged only for a regional hospital and hospital accessory uses limited to" uses outlined in the code. The permitted uses left off the category of"food, drugs, etc." which would be a pharmacy. St. Luke's has expressed interest in adding a pharmacy to the site which has triggered this PUD amendment. After talking with Staff, the applicant has further expressed a desire to clean up the PUD, so this doesn't happen in the future. Due to this desire, the applicant has added verbiage to revert to all permitted uses within the base zone (C-1) and added some other uses that could be a part of the existing or future facility, such as "indoor& outdoor recreation facilities". After analyzing the site, staff and the applicant noticed that the eastern portion of St. Luke's property is within a Planned Unit Development called North Pointe Park PUD. North Pointe Park PUD was created in September 2009. Sometime after the inception, St. Luke's acquired the property. To avoid confusion for staff and the applicant, the applicant has expressed desire to combine the master plan for North Pointe Park PUD with St. Luke's PUD. Proposed Changes are as follows: 1. Updating Master Plan to accommodate a portion of North Pointe Park PUD. 2. Allow for the base zoning (C-1) uses be permitted. 3. Continue to allow for several uses to be permitted by right, that are not currently permitted by right within the C-1 zoning district. 4. Add the land use classification of"Indoor and Outdoor Recreation" facility to be permitted by right. Possible Impacts and Mitigation: Staff does not foresee any negative impacts to the surrounding area with this proposed amendment. It will allow for reasonable uses that the public expect to occur at a hospital. The Commission is tasked with making a recommendation on the Amendment of"St. Luke's PUD" to change the Master Plan and allow, by right, for the land uses of"Food, Drugs, etc." & "Indoor Recreation". Staff proposes the following conditions: 1. Subject to site plan amendments as required by Building, Engineering, Fire, and Zoning Officials to ensure compliance with applicable City Code Requirements and Standards. Applicant Presentation: Curtis Weedop from St Lukes presented his request. He stated they want to merge two PUD'a into one and include more commercial uses. Public Hearing: Opened and closed with no public input. Discussions Followed: Commissioner Rambur stated that he feels this fits in the area. Commissioner Petruzzelli agrees this is a good fit. Commissioner Zimmerman feels this is harmonious to the area. Commissioner Weatherford feels it fits the area also. Chairperson Titus wanted clarification that this isn't changing any zoning requirements. Senior Planner Klaver stated the rec center is being included with this request. MOTION: Commissioner Petruzzelli moved to recommend approval of the request for a recommendation to City Council to amend the St. Lukes PUD, adding multiple land uses, and modifying the Master Plan layout on property located at 801 Pole Line Rd West, as presented, with staff recommendations. (PZ24-0033) Time Estimate: Approximately 5-10 minutes for the presentation with questions/comments to follow. Background: A Special Use Permit (SUP) application has been submitted pursuant to Twin Falls Municipal Code Section 10-13. The applicant, Rebecca Chambers, has submitted a SUP application to allow for a Crossfit gym at the property generally located at 163 3rd Avenue South. The property includes one (1) parcel and encompasses a land area of 0.28 acres or 12,212 sq. ft. (more or less). Approval Process: Per City Code 10-13-2-2 The Special Use Permit process requires a public hearing in which interested persons have the opportunity to be heard, with regards to the application. The Commission shall decide on the request within thirty (30) days after the public hearing. If Conditions of Approval are placed on the permit by the Commission, the Administrator shall issue the permit specifically listing such conditions. Conditions shall be implemented within 6 months, or the permit is void. If the Commission's decision is appealed within fifteen (15) days of the signing of the Findings of Fact, City Council shall set a hearing date to consider all information, testimony, and minutes of the previous hearing to reach a decision on the appeal. Standards Applicable to Special Uses: • Will, in fact, constitute a special use as established by zoning requirements for the zone involved. • Will be harmonious with and in accordance with the general objectives or with any specific objective of a comprehensive plan and/or zoning regulations. • Will be designed, constructed, operated, and maintained to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity and that such use will not change the essential character of the same area. • Will not be hazardous or disturbing to existing or future neighboring uses. • Will be served adequately by essential public facilities and services such as highways, streets, police and fire protection, drainage structures, refuse disposal, water and sewer and schools; or that the persons responsible for the establishment of the proposed use shall be able to provide adequately any such services. • Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community. • Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any person, property or to the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors. • Will have vehicular approaches to the property which shall be so designed as not to create an interference with traffic on surrounding public thoroughfares. • Will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance Approval of this zoning request does not preclude the applicant from obtaining the required permits/or licenses needed to complete the project. Should the commission approve the request, a building permit will be required. The building permit review will take into account a change of use which will trigger required improvements to the building and the site. Budget Impact: NA Regulatory Impact: Per City Code 10-4-13 states "a special use permit is required for 'indoor recreation facility"' 10-13-2-2: Upon granting a Special Use Permit, conditions may be attached to a Special Use Permit including, but not limited to, those: 1. Minimizing adverse impact on other developments. 2. Controlling the sequence and timing of development. 3. Controlling the duration of development. 4. Assuring that development is maintained properly. 5. Designating the exact location and nature of development. 6. Requiring the provision for on-site or off-site public facilities or services. 7. Requiring more restrictive standards than those generally required in this Title. History: The building was constructed circa 1931 according to county records. It's most recent use was for a construction trade office M&M Electric. The building housed their office and their inventory. The new tenant would like to convert the inventory storage area to a Crossfit gym and use the office area as it was designed. Analysis: The property is located in the Old Town (OT) zoning district within a P3 Parking Overlay. The OT zoning district requires a special use permit for the land use classification of"indoor recreation facility". The zoning district provides development standards for properties in the zone. In this zone, 10% of the total parking area shall be landscaped. However, the property is located within the P3 Parking Overlay which allows the parking requirement to be determined by the Commission. A layout of the surrounding area has been provided by the applicant and is color coded to illustrate the parking areas available for staff and customers to park. Staff has reviewed this document and has determined that there is ample off-site parking available. Hours of Operation: M-F S:OOam to 8:OOpm Sat-7am-11am Sun-8am-10am Traffic Anticipated: Employees: 4 Customers: 1-18 (per class) The applicant has stated the larger classes are held before ten o'clock (10:00) AM. The exercises are varied functional movements and can include actions such as air squats, dead-lift, shoulder press, pull- ups, push-ups, sit-ups, running &jumping. The classes will consist of a warm-up, a workout, and a cool down. The majority of the scheduled classes will occur in the earlier hours of the day between five o'clock (5:00) AM and ten o'clock (10:00) AM with afternoon classes occurring between three o'clock (3:00) PM and three o'clock (8:00) PM. The applicant has provided a floor plan showing the layout of the workout areas. These areas have been arranged so that the weight lifting area does not abut the wall adjacent to the alley to reduce vibration impacts in case weights are dropped. They will have racks and platforms for the weights. The group exercise area will be in the center of the building, with bikes, rowing and other equipment will be positioned along the exterior walls. The applicant has provided a site plan showing the location of the trash enclosure, an improved sidewalk with an ADA-accessible route, along with a future parking area. The applicant has been informed they will need to work with the engineering department should they decide to provide parking on-site in the future and that hard-surfacing will be required. Staff reviewed the site plan with the applicant and explained operations of the business may begin upon receiving a certificate of occupancy. Potential Impacts: • Noise and vibrations. Staff has received complaints/concerns regarding the vibrations generated by heavy weights being dropped on the floor. The applicant was contacted to discuss this concern, and it was reported that she was moving equipment into the space and weights were being dropped on the floor. The adjacent business owner approached the applicant regarding her concerns and efforts have been made to address these issues. On May 7, 2024, a vibration analysis was performed and coordinated with Float Magic to assess the impact of the vibration and possible mitigation solutions. Staff has received the report and the findings did not suggest mitigation was necessary. • Staff does not believe the proposed land use would have any negative impacts on the surrounding properties due to glare, odor or fumes. Conclusion: In summary, the plan is to have an open area for exercise classes, exercise stations for individual use and to upgrade the bathrooms to ADA standards.Approval of this Special Use Permit request does not preclude the applicant from obtaining the required permits and/or licenses needed to complete the project. Should the Commission recommend approval of the request as presented, staff recommends the following conditions of approval: 1. We are requesting a Special Use Permit to allow a new CrossFit gym to be constructed in an existing building. The existing building will be remodeled to provide this new occupancy. The site is located in the P3 parking overlay. An onsite parking lot will be added on as phase 2 to the area west of the building. Please see the attached ariel view of the surrounding existing building and projected parking options. B. i. The gym's operational hours are as follows: Monday—Friday 5 a.m. to 8 p.m. Saturday 8:30 a.m. -12 p.m., Sunday 8 a.m.- 10 a.m. Refer to the attached schedule for details on class arrangements. ii. The traffic anticipated will be the vehicles visiting the site. iii. There will be 4 employees present during operational hours All employees are coaches. Each class is led by at least one coach. During open gym time, at least one coach will be present on-site. Iv. There will be 1-18 people in class.No more than 18 in a class. All larger classes(up to 18) are held before 10 a.m. V. The exercises performed in the classes will consist of the following: CrossFit exercises are constantly varied functional movements. Functional movements are those movements that are"essential"to life demands. Examples of CrossFit functional exercise movements are(1)air squats(getting up out of a chair requires an air squat); (2)a deadlift(picking up groceries from the floor requires a deadlift); (3) a clean(getting a five-gallon water jug from the ground onto a table requires a clean); and a shoulder press(placing items on a high shelf requires a shoulder press). CrossFit functional exercise movements further include gymnastic movements(pull-ups,push-ups, and sit-ups)and cardio exercises(running and jumping). vi. There is one door on the east side of the building that will be opened if the workout includes running outside. Additionally,the gravel area on the west side of the building will not be used for any outside exercise space. The door on the north side of the building nearest the alley will remain shut at all times and weather stripping will be added/repaired to help with sound control and heat gain/loss. C. i. During construction,there will be minor effects from noise,glare, odor, fumes,and vibration. After construction,there will be minimal effect of noise on the adjacent property. There will be short-term noise from construction-related activities (6:30 a.m.to approximately 6:30 p.m.). Long-term noise will be from vehicles, and customers,coming to and going from the site. It will be similar to the noise created by other businesses in the surrounding area. ii. This project will not increase the glare,because the exterior of the building remains the same. iii. Odor; There will be some odors during construction. The odor from the facility will not be increased from the current use. iv. Fumes and vibration on adjacent property. There will be minimal impact on the adjoining property during the renovation work. During regular operation, on occasion when weights are used,noise and vibration will be mitigated by specialized platforms and mats.Weights are not used every day. V. This project is compatible with this area as there are other entertainment, dining facilities, Jump time and Soccer time nearby. BULLAMIG THE FUTURE ON FOUNDATION OF EXCE11ENCE May 8, 2024 TF Crossfit RE: Vibration Monitoring Results To Whom It May Concern: EHM Engineers, Inc. has been retained to provide vibration monitoring at the Float Magic building located at 152 2"d Avenue South in Twin Falls, Idaho. EHM understands that the purpose of the vibration monitoring was to capture measureable events related to the proposed operation of a crossfit gym which is to be located in an existing building which address is 163 3rd Avenue South in Twin Falls, Idaho. The procedure and conditions related to the vibration monitoring are outlined below: TF Crossfit organized a typical class scheduled to run from 41)m to approximately 5:30 pm on Tuesday May 7, 2024. Their activities included lifting and throwing of lifting bars and weights which was reported to EHM to be the cause for concern and the source of vibration disturbance to the neighboring Float Magic business. EHM Engineers, Inc. setup two seismic monitors (SN UM 139oo and SN BE r7000) at the site location. Monitor identified as BE 17000 was setup in the alleyway between the two buildings at the north corner of the crossfit gym building near the gas meter and was staked into the earth, buried and covered with one loosely filled sandbag. The second monitor identified as UM 13900 was setup within the Float Magic business along the southern wall nearest the alleyway. This meter was placed without any anchor spike on the vinyl flooring near the float bath and covered with two loosely filled sandbags intended to secure the monitor to the flooring surface.Trigger limits were set on each monitor for o.o5 in/s for monitoring purposes. The following scenarios were observed: i. As the crossfit class began lifting and throwing weighted bars around 4:30pm the monitors were set to record. a. Monitor BE 1700o recorded the following peak particle velocity (PPV) for vibrations observed and recorded at the alleyway: i. o.162 in/s @ 4:39Pm Note: Additional recordings were collected and are attached hereto, however the peak value is as reported above. b. Monitor UM 139oo did not record any events as the trigger threshold was not reached. The crossfit class was asked to stop and rest with no weighted bars being lifted or thrown.A 3/4 ton work pickup was staged in the alleyway to simulate vehicular traffic in the alleyway around 4:52pm and the monitors were set to record. a. Monitor BE r7000 recorded the following peak particle velocity (PPV) for the vibrations observed and recorded at the alleyway: i. o.14i in/s at 5:oopm b. Monitor UM 1390o did not record any events as the trigger threshold was not reached. However, histogram readings were collected and indicate a peak particle velocity observed and recorded within the Float Magic Building as follows: i. 0.029 in/sec at 4:55 Pm Note: No PPV values were observed above 0.04 in/s during this period of activity. 3. The crossfit class was asked to load the weighted bars heavier and have the men in the class lift and throw as if a max-out type work-out was being conducted and the use of"crash pads"were employed for this heavier lift scenario at around 5:12pm and the monitors were set to record. a. Monitor BE r7000 recorded the following peak particle velocity (PPV) for the vibrations observed and recorded at the alleyway: i. 0.192 in/s at 5:13Pm b. Monitor UM 139oo did not record any events as the trigger threshold was not reached. However, histogram readings were collected and indicate a peak particle velocity observed and recorded within the Float Magic Building as follows: i. 0.025 in/s at 5:13Pm Note: No PPV values were observed above 0.04 in/s during this period of activity. In summary, the maximum PPV observed and reported related to any of the activities or conditions resulted in less than 0.20 in/s magnitude at frequencies between 4Hz and 5oHz. The comparative results from the activities related to the crossfit gym and the proximate alleyway vehicular traffic loads was very minimal. Peak particle velocities differed by only 0.05 in/s at a maximum and a minimum difference within the Float Magic Building of 0.004 in/s magnitude. GONSTRUCTION MGI I 1 It is generally accepted by construction industry standards that vibrations which result in PPV values greater than 0.50 in/s for buildings with plaster finishes and values greater than 0.75 in/s for buildings with drywall finishes will be the minimal threshold for the appearance/observance of the onset of potential damage to structures. In short, until the above stated thresholds are reached, not even the slightest elongation of cracking within either plaster or drywall is evident. Regulations and guidelines have been established for blasting operations and it is a common practice to apply these to ground vibrations from construction equipment. Because standard regulations and criteria are so conservative, there is little evidence to suggest that the duration or number of repeated events [causing vibrations] need special consideration when those standards are followed. Fore example, the Office of Surface Mining (OSM) regulations recognize that many large-scale mining operations will continue for many decades. Some operations have been in existence for more than a century. When the regulations were developed, it was common knowledge that homes in such areas would receive vibrations at relatively low frequencies for decades. (Oriard 2005). Further, it is the opinion of EHM Engineers, Inc. that the vibration levels observed in all cases are consistent in magnitude to adjacent street traffic impacts related to vehicular access and travel through the alleyway. EHM believes that heavier vehicles than a 3/4 ton pickup will utilize and commonly access the alleyway, such as trash and refuse trucks. "The most commonly used limitations are quite properly very conservative. They are intended to prevent even threshold damage (lengthening of hairline cracks), even in poorly maintained houses." (Oriard 2005). It is EHM's experience that most lay persons reactions are based upon perceived noise, whereas damage investigation must focus on the intensity of stresses generated within structural members. I am the owner of Float Magic located at 152 2"d Ave S.The idea for Float Magic began in 2019, wherein I wanted to provide a place of relaxation and healing in Twin Falls. Before deciding on a building for my vision, I thoroughly conducted analysis as to carry out due diligence for an appropriate atmosphere and location to build a sanctuary. As you know, that process was lengthy, difficult, and expensive, but we were successful in accomplishing our task and opened our doors a year after submitting our building permit in February of 2021. Since opening, we have served over 6,700 clients, i including veterans, teachers, athletes, active military, and business professionals, We have also served nearly 200 first responders through our EWELL Lifeline program. Our services have proved to be beneficial in treating anxiety, depression, PTSD, and the physical demands and emotional traumas often associated with many high stress positions. Because the services we offer are heavily dependent on sensory deprivation, meditation, and relaxation, it is imperative that we maintain a tranquil atmosphere. Our floatation therapy consists of float tanks filled with heavy salinated water to deliver these effects. As you know, water amplifies vibration and sound. Noise disturbance and any detectable seismic interference are incredibly detrimental to the treatments' effectiveness, and the continued success of Float Magic. A mutual friend introduced me to Becky Chambers and informed me of the plans to bring in TF CrossFit to the building directly behind Float Magic in April. I was excited because we have many synergetic relationships with other health, fitness, and athletic-focused businesses due to our effectiveness on recovery. I was proactive in reaching out to the owners and we have communicated about their progress. One concern that has come up is that CrossFit exercises often include dropping heavy weights or other objects. As individuals have been using equipment during their testing and building process, it has created a significant disturbance throughout our building, but most notably in our float rooms. The sound is audible as the concussive force travels to our building and can be felt by individuals using our services. It has been referred to as a drum beating or distant repetitive booms in what is supposed to be a calm, quiet, disturbance-free environment. I have spoken with Becky Chambers and Laura Fitzgerald on several occasions to address these concerns and to discuss options for a workable solution. One idea that has the best likelihood of success is for the facility to have a "false floor' that would dampen the sound and absorb the vibrations. I spoke with Colby Ricks, who was also the architect on the Float Magic building. He had mentioned that a false floor was likely the best remedy for this problem. I want to be and have been proactive and transparent on this issue, and I want TF CrossFit to be successful. I am hopeful that we can work together for many years to come in providing health services in Twin 2 Falls, but if the expected activities continue without proper vibrational mitigation, I will no longer be able to operate Float Magic unless the noise and vibration nuisance is addressed in the special use permitting process. I know that I have civil remedies available should I be forced to close my doors. I do not want to go that route, nor do I want that kind of relationship with my new neighbors. That is why I am asking this commission to require that the sound and seismic issues be addressed before a permit is issued. I know that TF CrossFit is required to address the effects on neighboring properties in its application (Twin Falls City Code §10-3-4(D)(2)). I am not aware of the extent this will be addressed, but I know the owners and I have discussed it on several occasions to address the impact their regular occurrences may have on my services before getting much further in the process. As you are aware, the commission must consider the effect of the "operation that will be detrimental to any person, property or to the general welfare of the surrounding neighborhood" and any adverse effects caused by the expansion (Id.). While the sound and vibration adversely affect my business, I am most concerned that limiting operations in either their business or mine will not be a successful outcome.The best outcome will be mitigating the vibrational effects so that both businesses may operate at full capacity. Again, I do not want to be a hinderance to TF CrossFit's success or delay the opening of this project. However, addressing these issues now is far more likely to be beneficial to all parties in the long run. Please require a false floor to be installed as part of the permit, limit outdoor activity such as weightlifting, tire flipping, loud music or anything that would potentially carry to my business without proper mitigation. I also request that vehicle traffic from their clientele be limited from driving directly behind my building and essentially my float tanks so that the seismic and noise disturbances can be eliminated. 3 Thank you for your time and consideration. They started with spinning bikes, pull-ups, and bar lifting that didn't make any vibrations in the CrossFit Building.When the workout added weights to the bars, individuals were dropping them throughout their workout which created a Lot of reverberation from the metal weights hitting the floor. I observed for about 45 minutes and I had a headache afterwards because of the vibrations. I previously worked at Bearded Axe, the axe throwing gym, and without absorption earplugs,would get the same headaches from the reverberation of the metal axes constantly hitting the wall. Something needs to be done to absorb the reverberations to create pleasant experiences for surrounding businesses' clients as well as potential clients for i the CrossFit gym. It was demonstrated to me that the weights can be dropped with crash pads underneath which decreased the reverberation significantly.
