AGREEMENT
THIS AGREEMENT, made and entered into this 21stday of
August, 1972, by R. E. YOUREE, an individual and President of Youree
Motor Company, the party of the first part, hereinafter referred to as
the "OWNER" and the CITY OF TWIN FALLS, a municipal corporation,
party of the second part, hereinafter referred to as the "CITY"
WHEREAS, the OWNER owns Lots 6, 7, 8, 16, 15, and 14 of Block
108 of the Twin Falls Original Townsite in Section 16 of Township 10 South,
Range 17 East, Boise Meridian; and
WHEREAS, there is existing curb-gutter on the Main Avenue side of
said property, but there is no curb-gutter or sidewalk on the 7th St. South
side or the 2nd Avenue South side of said property; and
WHEREAS, the CITY has adopted Ordinance No. 1531 which requires
that concrete curb and gutter and sidewalk shall be constructed with all new
building construction or modification in accordance with City Standards, and
WHEREAS, the OWNER is constructing an addition to an existing
building which is a modification of said building; and
WHEREAS, the City Council granted a deferment, which is allowable
under the provisions of Ordinance No. 1531, for the construction of side-
walk along 7th Street South adjacent to said Lot 8, Block 108 and for the
construction of curb-gutter and sidewalk along 7th Street South adjacent to
said Lot 16, Block 108 and along 2nd Avenue South adjacent to said Lots 16,
15 and 14 of Block 108.
NOW, THEREFORE, in consideration of the mutual covenants and
agreements herein contained, the parties agree:
1. The CITY will grant a temporary deferment on the construction
of sidewalk along 7th Street South and 2nd Avenue South and curb-gutter
along 7th Street South and 2nd Avenue South adjacent to Lots 16, 15 and
14 of said Block 108.
2. The OWNER agrees that he will construct curb-gutter along
7th Street South adjacent to Lot 6 of said Block 108, at 's expense, pt-�—

3. The OWNER agrees that upon notification by the City or when
any new construction or modification occurs on the property or when any
change in use occurs, he will construct, at his expense, sidewalk adjacent
to Lots 6, 16, 15 and 14 of said Block 108 within thirty (30) days of notifi-
cation.
4. The OWNER agrees that upon notification by the City or when
any new construction or modification occurs on the property or when any
change in use occurs, he will construct, at his expense, curb-gutter
adjacent to Lots 16, 15 and 14 of said Block 108 within thirty (30) days of
notification.
5. The OWNER further agrees that all curb-gutter and sidewalk
described herein shall be constructed in accordance with the CITY'S plans,
specifications and standards and shall be inspected and approved by the
CITY.
THIS AGREEMENT shall bind

IN WITNESS WHEREOF, the parties hereto set their hands and seals
on the day and year above written.

public in and for the State of Idaho, personally appeared the above named
R. E. YOUREE, known to me to be the person who acknowledged the fore-
going instrument, and acknowledged to me he executed the same.
