Fields, City Engineer �#seRvsN$.44 Request: Consideration of a request by Jubilee House, Inc. Board of Directors to present more information to the Council for abatement of the paving requirement. Time Estimate: The applicant would like to give a 15 minute presentation. Following the applicant's presentation,staffs presentation will take about 5 minutes. Following the presentations,staff anticipates some time for questions and answers. Background: Code Section 10-11-1,which is provided in the paragraph below,states that the surfacing requirement is to be applied any structure is constructed or the use changes. It allows a deferral to be placed on the surfacing requirement for 3 years. The improvements required herein shall be provided whenever a building or structure is constructed,placed, erected or enlarged or when there is a change of use of a building,structure or parcel of land.Unless otherwise provided,all required improvements shall be a condition of any building permit and they shall be completed prior to final inspection and occupancy of the building. If cost of improvements required by sections 1 1-2 through 10-11-5 of this chapter exceeds twenty five percent(25%)of the cost of the proposed private improvements,an agreement may be negotiated to allow the required improvements to be staged over a period of time not to exceed three(3)years.Whenever a building is constructed, placed, erected or enlarged and that building is in an isolated or undeveloped area, public improvements may be deferred by the council in cases where a deferral would otherwise be unavailable.Any improvements required by sections 10-11-2 through 10-11-5 of this chapter are not required for minor modifications or additions to existing buildings or structures when the modifications and improvements do not constitute more than a twenty five percent(25%)increase over the square footage of the existing buildings or a total increase in square footage over ten thousand (10,000) square feet,whichever is less,within any three(3) year period from date of completion of other expansion.(Ord,2550,6-2-1997) Code Section 10-114(B)states: Surfacing:All parking and maneuvering areas shall be hard surfaced with Portland concrete or asphaltic concrete surface material.In the M1 and M2 zoning districts,the requirements in section 7-1-20 of this code will apply. (Ord. 2550,6-2-1997) The Code section was intended to place the City in a position where maintenance issues associated with excessive dirt on the roadway are minimized. It is also intended to address our stewardship needs for cleaner water bodies,As you may be aware, at some paint the EPA will require the City to stormwater in an aggressive and proactive manner. This project is an R-6 PUD so the requirements of Section 7-1-20 do not apply. Also,the drive-in movie theater precedes the Code. Jubilee House representatives asked the City to consider a double-chip as compliance with the surfacing requirement.Double chip is a chip seal placed on dirt and does not comply with the Code.It is a good application for keeping sediment off the road and out of Rock Creek/Snake River. However,it is not a long term solution and needs to be reapplied every 3-4 years, Acknowledging the limited financial resources of this organization, the Engineering Department offered to extend the deferral for about the length of the life of the double chip to allow for continued fundraising..In late August, Engineering staff reported that Jubilee House representatives found the double chip expense, at about$12,000,to be too expensive and that, if required,they'would need to close their doors', Approval Process: Budget Impact: There is no immediate budget impact associated with the Council's approval of a request to not conform to the Code. In the future, the City will be required to mitigate the impacts of sediments in stormwater. It is anticipated that the City will need to construct improvements where and when they are not required by Code.The actual financial impact to a future budget is not known at this time. They rely on donations for • the services they provide and the need always exceeds the donations. The community has repeatedly stepped forward to keep this facility open and the valuable services available. The current demand from The City to pave their access road appears to be unnecessary. T would encourage the Twin Falls City Council to find a compromise that would allow the facility to continue to operate with the all weather gravel access road. The access road, in my opinion, provides adequate service for clients and emergency vehicles. Gravel drives and streets are not unique in Twin Falls. During these difficult economic times we all need to be thankful for and assist organizations such as Jubilee House that accommodate people who would otherwise be forced to rely on local government for accommodations and services provided at Jubilee House. As we hope you will see, we believe that the paving requirement is based on incomplete information about the property and an economy that no longer exists. BRIEF FACTUAL BACKGROUND Jubilee House, Inc. was formed on or about February 9, 2008, under the Idaho Non- Profit Corporation Laws and recognized as a non-profit corporation under Section 501 (c) 3 of the Internal Revenue Code. It has been organized exclusively for charitable purposes to support a life style of health and recovery for its residents. We provide teaching, counseling, and mentoring as well as food and housing for the residents, just to name a few of our program provisions. All services are offered free of charge based on need and not ability to pay. Currently and in the past, we have had residents that have come to us directly from incarceration. Because of their inability to pay, many of the women who become Jubilee residents would not be able to obtain many of the services we offer anywhere else. Community Christian Church leases the property to Jubilee House, Inc. for the purpose of operating a recovery home. Jubilee House maintains our own 501 (c) 3 status, files its' own Federal Income Tax form 990 for Non-Profits, and does not function as a ministry of the church. SUBSTANTIVE ISSUES Jubilee House, Inc. operates outside the City of Twin Falls limits, but falls within the impact zone. When the license for operation was issued, Jubilee House, Inc. was required to pave the driveway and the parking T area within a three-year time frame, which will expire in March of 2011. Some of the reasons for this requirement were the impact on the neighboring businesses from the gravel drive and fire equipment access. Jubilee House has operated for two years and eight months with the existing gravel lane. We have had no issues with the quality or accessibility that this lane has offered. N a This included all heavy construction equipment used during the moving and setting up of house, the mandatory planting of trees and shrubs, the monthly access for garbage disposal trucks as well as the daily traffic of staff and volunteers. As for our neighboring businesses, the lane that leads to the driveway is adjacent to Grandview Drive-In Theatre to the South, separated by approximately ten (10) feet. The property of Grandview Drive-In Theatre is gravel. The property that is adjacent to the North is a bare field owned by the Community Christian Church. They hold the lease to the property utilized by Jubilee House, Inc. and have no objection to the lane remaining gravel. To the East is the canyon and directly to the West is a paved parking lot owned by Community Christian Church. The church and the Grandview Drive-In are accessible from Grandview Drive off of Addison Avenue West. Jubilee House actually sits more than 700 feet East of Grandview Drive. Jubilee House, Inc. operates solely on private donations, community support and foundation grants. Due to the downturn in the economy over the past two years, our financial status is considerably lower than originally projected. We cannot assume that this will improve in the next three years. Jubilee House has made major cut backs in our spending, we are relying heavily on volunteers, donations of food and other supplies and we utilize services in the community where practical. Staff has taken a reduction in hours, the Executive Director has, on more than one occasion, forgone her paycheck to maintain the funds to operate the program. Although Jubilee House has only been serving the Twin Falls community for 2 years and 8 months we have had remarkable results with our program. Currently over 90% of our graduates are still in recovery, all of which are employed and living as contributing members of the community. We have 4 women graduating in November 2010. All 4 are employed and for attending The College of Southern Idaho or another Idaho College. Statistics from the Department of Health and Welfare state: • $66 million dollars per year is spent to incarcerate Idaho drug users • Every dollar spent on recovery saves $12+ in societal costs • Only 1 in 50,000 addicts will remain in recovery without a program • Typical success rates for Drug Rehabilitation programs are less than 20% • Success rates greatly increase with programs lasting longer than 3 months Using the statistics from the department of Health and Welfare and based on our current success rate it can be extrapolated that Jubilee House has or will save the City and community of Twin Falls more than $2,400,000.00 due to the services offered since our beginning. FORMAL REQUEST The requirement to pave the driveway would be substantial enough in its financial impact as to make closing our facility a very real probability. This would affect the employees as well as the residents and their families, the court system, as some of our i residents are court ordered into our program. It would also have a direct as well as an indirect negative financial affect on the City of Twin Falls. We are and have been attempting to secure funding for the paving of the drive through private donations and grants. We have every intention of being good neighbors and good city residents. That's why we are pursuing grants to get this done. In this economy, where businesses in Twin Falls are closing every day because people don't have money to spend, how can the City Council expect those same people to come up with the money to donate to pay for the incredible expense of paving or chip sealing. We have been made aware that if we request and receive a deferment it could be called due at any time and that Twin Falls Community Church would be held liable because of their ownership of the property. As I mentioned previously, Twin Falls Community Church is not directly involved in Jubilee House, and under no circumstance would we consider putting them in a position of liability. I am certain it is not the intent of this respected body to arbitrarily enforce codes, but instead to see that the purpose and intent of these codes be maintained. That the overall good of the residents and the City of Twin Fails be the primary focus at all times. I am not pretending to understand all that is involved in the determination of the cost benefit of these codes, or the possibility of future affects. But, I do question if the possibility of having water issues in the future, or the fact that dust from our driveway may affect the road at some future date outweighs the lives that have been and certainly will be positively affected by the continued operation of Jubilee House's Full Life Recovery Program. Jubilee House, Inc. believes that we have submitted enough information to request that the requirement to pave the drive at 315 Grandview Drive be removed as a stipulation of doing the business of Jubilee House. She said that she left you a message last week and hadn't heard back from you yet- she said that Jubilee House was given three years to complete the paving of their drive and turn-around off of Grandview Dr. She said that their three years is up in January and they have been working with a contractor to get the paving completed. She had a contractor at the site doing a bid and he asked if they could do a specific type of surfacing and so she was calling to find out what the exact requirements are for paving. I told her the code says Portland concrete or asphaltic concrete surface and so that it would have to be approved by the Engineering Department. I told her that it is best to have the contractor call the Engineering Department and talk to Jackie to review the surface material and she determines if it is satisfactory. She said that she is definitely hoping to get the paving done before fall but if she is not able to she wanted to know what they could do. I told her that the file would have to be reviewed to see if the three year timeline was a staff approval of phasing or a Council-approved deferral. Either way it would have to be reviewed by the applicable group to see if an extension could be granted. She said that she would let us know if it was looking like they would not be able to get it done this year. Developer agrees to pay all costs resulting from his failure to properly schedule and request a required inspection or from proceeding with work before receiving approval to proceed. Developer agrees to remove or correct any rejected, unapproved or defective work or materials, all as required by the City Engineer. Required inspections shall include: 1) approval of all materials before inspection; 2) approval of forms and gravel base before pouring any concrete curb- gutter or sidewalk; and 3) approval of all finished improvements. VI. The Developer agrees to: 1) allow the City full and complete access to the construction; 2) provide all materials necessary to conduct all tests; and 3) provide the equipment and perform or have performed any testing of manufactured materials required by the City Engineer. VII. Developer agrees to obtain any necessary permits from the Twin falls Highway District or the State of Idaho Department of Highways prior to constructing improvements on their respective rights-of-way if said permits are required by the aforementioned agencies. A certified copy of said permit or the original of said permit shall be submitted to the City prior to beginning construction thereon. This Agreement shall be recorded and shall bind the parties hereto, their heirs, successors in interest, and lawful assigns. In the event of a breach of this Agreement, or should legal action of any kind be taken to enforce the provisions hereof, the prevailing party shall be entitled to reasonable attorney fees and costs awarded by the Court.
