The way the site sits, about one-half of the water will drain to Elm Street, and the other one-half will disperse over the existing lawn area. l also attached a PDF of the entire site to show that we have well over 28,000 sq.ft.to disperse the 288 c.f. This development was completed in the early 1940's, before there was an Elm Street. I hope this helps. There is a "Cooperation Agreement' between the City and TF Housing Authority signed in November 1973. At that time you told us that there would not need to be a non-conforming building permit expansion or zone change for the project. There is a copy of the Cooperation Agreement at G:workarea\Planning &Zoning\PUD Agreements-approved\#3-Twin Falls Housing Authority. I now have a new building permit application for a new shop at the same location. I have an issue with storm water retention. Russ Lively is telling me that because of the agreement it is ok for half of the storm water to drain onto Elm St N. Zoning Code 10-11-8(F) states that no discharge of storm water will be allowed off site. Please let me know if the agreement exempts the TF Housing Authority from having to retain all their storm water on site. If you need me to send you a copy of the agreement, let me know. This is a large development built in the early 1940's,before there was an Elm Street. It was my intent to use the original vast lawn area for the additional run- off, but of course that project(Re-asphalting)was not included with this permit, so you couldn't have known how much area I am referring to. Sorry for that. I forwarded your justified request for calculations to the Twin Falls Housing Authority as there is an agreement between the Housing Authority and the City of Twin Falls as it relates to City Code. City agrees: 1) to defer construction of the required sidewalk until or until such time as the obligation of sidewalk construction on adjacent property or properties allows the City Engineer to require construction under the conditions specified in City Code Section 10-11- 5(B) (2) . II. Developer agrees to: 1) complete construction of sidewalk on the real property described above when required by the City Council. III. Developer further agrees that in the event the Developer fails to complete the aforementioned construction, the City may complete the construction at the City's expense and may file a lien against the aforementioned property for expenses incurred by the City in said construction. IV. Developer agrees to pay the total actual cost of all materials, labor and equipment necessary to completely construct all of the improvements required herein and to construct or contract for the construction of all such improvements. V Developer agrees to request in writing that the City Engineer and any other required department of the City make the following inspections and to not proceed with construction until the required inspection is complete and the work has been approved in writing by the City Engineer or his aut rized inspector. . 411%,such inspections shall be eduled fifteen (15) days pr' to beginning work and the request for an insp ion shall be made one workiM day before the required inspection. The Developer agrees to: 1) allow the City full and complete access to the construction; 2) provide all materials necessary to conduct all tests; and 3) provide the equipment and perform or have performed any testing of manufactured materials required by the City Engineer. VII. Developer agrees to obtain any necessary permits from the Twin Falls Highway District or the State of Idaho Department of Highways prior to construction improvements on their respective rights-of-way if said permits are required by the aforementioned agencies. A certified copy of said permit or the original of said permit shall be submitted to the City prior to beginning construction thereon. This Agreement shall be recorded and shall bind the parties hereto, their heirs, successors in interest, and lawful assigns. While we do everything we can to provide accurate telephone estimates of fees, we acknowledge that in some circumstances our estimates may miss the mark. Until plans are submitted and we truly are able to understand the type and scope of construction and occupancy classification, we are only guessing at fees to be assessed. From what you have told us, you received an estimate for permit fees in the ballpark of $1200 for work that was to be performed for the Twin Falls Housing Authority. Plan review fees were not included in that figure. The inspector who gave you the estimate-- whose customary duties, by the way, do not include the estimating of fees -- did not realize from the lump sum value he was given over the phone that the work was varied in scope, involved both R-1 and R-3 dwelling units, and was to be performed at multiple sites, each requiring a separate permit and fees. Once the plans were submitted and our regular fee assessment person was able to review the scope of the project, a total figure substantially different from the estimate was assessed. I apologize for the disparity between the estimate and the actual. As you know, the City of Twin Falls waived all permit and plan review fees for the Housing Authority. It is my opinion that if the Housing Authority is looking for a credit from you for fees waived, that the credit should be to the extent that you estimated fees in your bid, and not what the fees actually figured out to be. If I can be of any more help in explaining what happened and how building permit fees are assessed, don't hesitate to call me. WHEREAS, The Twin Falls Housing Authority, by and through Harald Gerber, has requested modification of the requirements of the Uniform Building Code pursuant to Twin Falls City Code Section 4-1-2 for property located in Sunny View Courts; and, WHEREAS, the Twin Falls Housing Authority desires to make improvements to senior citizens housing units by the addition of storm windows to be applied to windows adjacent to the doors; and, WHEREAS , the Twin Falls Housing Authority, by and through Harald Gerber, has submitted a written application for modifica- tions 'of the Uniform Building Code, which application is attached hereto and made a part hereof; and, WHEREAS, the City Council has reviewed the application of the Twin Falls Housing Authority for modification of the require- ments of the Uniform Building Code, and held a hearing at a meet- ing of the Twin Falls City Council on June 18, 1984 , at which time the applicant submitted a narrative statement and documentation. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TWIN FALLS, IDAHO: SECTION 1. After consideration of the information presented in the application, the City Council makes the following findings of fact and conclusions: (A) There are special conditions and circumstances exist- . ing which are peculiar 'to the land, existing structure, and proposed structure involved which are not applicable to other lands, struc- tures or buildings. (B) A literal interpretation of the provisions of the Uni- form Building Code as adopted would deprive the Twin Falls Housing Authority of rights commonly enjoyed by other property owners under the terms of those codes. (C) The granting of the modifications requested will not confer on the Twin Falls Housing Authority any special privilege that is denied by the Uniform Building Code as adopted to other lands, structures, or buildings. The property is separated from other private property by Addison Avenue East, Sycamore Street North and by a paved two lane service road that follows the Perrine Coulee. Modification requested: To permit standard glazing in the storm windows to be ap- plied to the windows adjacent to the doors, in lieu of Safety glazing. Reference: Uniform Building Code Chapter 54 GLASS AND GLAZING Narrative: 1. This Improvement Project to Senior Citizens Housing Units at ID 001003 includes the installation of storm windows in the windows of all the units as an energy conser- vation measure. One of the windows is in the living room of the units and is adjacent to the door; separated only by a mullion (approximately 6" wide). 2. The Uniform Building Code requires safety glazing at "hazardous Locations" (Sec 5406 (d); and No. 6 is applicable: "Glazing, operable or inoperable adjacent to a door in all buildings and within the same wall plane as the door whose nearest vertical edge is within 12 inches of the door in a closed position and whose bottom edge is less than 60 inches above the floor or walking surface." 3. This project does not call for replacement of glass in any of the existing windows; only the installation of separate, removable and operable storm windows in their own frames. Since this type of project does not include the replacement of the existing window at the door (UBC Section 104 (b)-Exception) this glazing will remain as it pre- sently exists. A. The existing window is a single-hung type which means it has a horizontal mullion through the center. The sill is about 3 feet from the floor. This makes the window readily visible and the chances of walking through the window by mistaking it for an open doorway are negligible, and no such event has occurred since the project's completion in 1962. B. The hazard existing by a person falling into the window is no greater than the hazard evidenced by other windows in the living room or bedroom; and in any event, no change will be made to the existing glass which would remain on the inside. C. The concept behind the UBC requirements seems to be a bit misdirected in that (for example) a small pane of glass measuring 4 inches by 4" would have to be safety glass (tempered, or laminated) if within 12 inches of the door, yet at a distance of 12", the glass can be up to 9 square feet (larger than a door) - provided the sill is above 18". Construction Documents were prepared to provide for compliance with the Uniform Building Code; i.e, installation of tempered glass in the storm windows at the unit doors. Provisions were made to use regular glass, however, by requesting bidders to submit an alternate quotation. Although the additional money may be a part of the reason for a request, it does not constitute the basis for the request, which has been enumerated above. As an item of interest, the apparent low bidder's figure to use tempered glass was in excess of $1000. This request is respectfully submitted on behalf of the Owner by Harald E.
