Dear Danny Edwards;
On March 26, 2002 the Planning and Zoning Commission approved a Special Use Permit to expand an
existing metal sculpting business. One of the conditions of the Special Use Permit was that you dedicate an
additional 15' right of way along 3400 North. It appears a Warranty Deed dedicating the additional 15' right of
way along 3400 North was not sent to you to sign. Attached is a Warranty Deed, a copy of the Special Use
Permit and a self-addressed envelope. Please sign the Warranty Deed and return to the City of Twin Falls.

Vice Chairman Frank called the meeting to order at 7:00 PM. He explained the public hearing
procedure to the audience and introduced Council and City Staff present.
PUBLIC HEARING ITEMS:
Item#1 Request of Danny Edwards for a Special Use Permit to expand an existing sculpting
business on property located at 2763 East 3400 North within the City's Area of Impact.
Danny Edwards, the applicant, spoke for his request.
Planning and Zoning Assistant Carraway reviewed the request using overhead
projections. She said staff recommended the following conditions be placed on this
permit, if granted:
1. The buildings to meet all building and fire code requirements.
2. Dedicate 15' of additional right-of-way along 3400 North Road.
The public hearing was opened.
No one spoke for or against the request.

The public hearing was closed.
City Engineer Young reviewed the need for the 15' of right-of-way dedication.
Commissioner Sanchez made the motion to approve the request with staff
recommendations. The motion was seconded by Commissioner Adkins and roll call vote
showed all members present in favor of the motion.
Item#2 Request of Los Lagos Property Owners Association and Canyon Properties, LLC for
Vacation of 50' x 417.40' public right-of-way located west of the Twin Falls Los Lagos
Subdivision and in the 1800 block of Blake Street North in the City of Twin Falls' Area
of Impact.
Rex Leforgee, representing the Los Lagos Property Owners Association, spoke for the
request. He also noted that the Canyon Properties had also joined in the request.
Planning and Zoning Assistant Carraway reviewed the request using overhead
projections. She said staff recommended all utility easements be retained and that
approval be subject to Engineering Department technical review.
The public hearing was opened.
No one spoke for or against the request.
The public hearing was closed.
Discussion followed on:
• the street is a public street but maintained by the applicant
• no negative future impact foreseen
Commissioner Adkins made the motion to approve the request with staff
recommendations. The motion was seconded by Commissioner Sturgill and roll call
vote showed all members present in favor of the motion.
OTHER ITEMS:
Item#3 Consideration of the Preliminary Plat of the Morning Sun Subdivision, 98.4 (+/-) acres,
located south of Falls Ave East, east of Carriage Lane (extended), west of Hankins
Road/3200 East Road and north of Filer Ave East in the City's Area of Impact.
RESCHEDULED FOR APRIL 9, 2002 MEETING.
Item#4 Preliminary presentation of Hankins Corner, LLC requests a Zoning District Change and
Zoning Map Amendment from RR (Rural Residential) to R-2 PUD (Residential; single
or duplex), R-2 PRO PUD (Residential; single or duplex with a professional office
overlay) and R-2 NCO PUD (Residential; single or duplex with a neighborhood
commercial overlay) for approximately 36.53 acres located south of Falls Avenue East
and west of Hankins Road in the City of Twin Falls' Area of Impact.

Fran Florence, 4129 Hidden Lakes Drive, reviewed his project using overhead
projections.
Discussion followed on:
• what is build out period between residential and commercial
• hopefully commercial will come early in the project
• the applicant would like to start this construction season
• project looks good for the area
• what plans for school pedestrian crossing and neighbors for crossing Falls
• no sidewalks are out there
• how will project impact School District
• only certain builders will be allowed to build in the project
• time frame on construction completion
• an anticipated seven year build out is expected
• Phase I will be commercial and corridor of houses fronting commercial
• no parks are planned—there is a lot of open space
• pro-overlay is proposed on Hankins Road
• neighbors are generally against commercial
Public comments were taken:
Jay Sudweeks 1124 Skyline Drive, was concerned whether the area would be annexed
into the City. He also requested a copy of the CC and Rs.
Mr. Florence said he and his wife and Doug and Teresa McCoy are the only investors at
this time. The other investors won't do unless the project is approved. Mr. Florence felt
the area would be annexed once the City services were in use.
City Engineer Young reviewed three documents that are required by the City when
developers are outside the City Limits.
Mr. Florence said he hoped the green area would be maintained with City participation.
He said the CC and Rs would be made available to the neighbors when completed.
Craig Crandall, 1095 Skyline Drive, said the lots in the project are smaller than other lots
in the area. Could they be made bigger?
Todd Minco, 1165 Skyline Drive, felt Falls Avenue was too dangerous for children to
cross—he was against the project.
Scott Allen 2923 Skyline Drive, said safety was a concern.
No action was taken on this item.

PUBLIC HEARING ITEMS:
Item#1 Request of Danny Edwards for a Special Use Permit to expand an existing sculpting
business on property located at 2763 East 3400 North within the City's Area of Impact.
Danny Edwards, the applicant, spoke for his request.
Planning and Zoning Assistant Carraway reviewed the request using overhead
projections. She said staff recommended the following conditions be placed on this
permit, if granted:
1. The buildings to meet all building and fire code requirements.
2. Dedicate 15' of additional right-of-way along 3400 North Road.
The public hearing was opened.
No one spoke for or against the request.

City Engineer Young reviewed the need for the 15' of right-of-way dedication.
Commissioner Sanchez made the motion to approve the request with staff
recommendations. The motion was seconded by Commissioner Adkins and roll call vote
showed all members present in favor of the motion.
Item#2 Request of Los Lagos Property Owners Association and Canyon Properties, LLC for
Vacation of 50' x 417.40' public right-of-way located west of the Twin Falls Los Lagos
Subdivision and in the 1800 block of Blake Street North in the City of Twin Falls' Area
of Impact.
Rex Leforgee, representing the Los Lagos Property Owners Association, spoke for the
request. He also noted that the Canyon Properties had also joined in the request.
Planning and Zoning Assistant Carraway reviewed the request using overhead
projections. She said staff recommended all utility easements be retained and that
approval be subject to Engineering Department technical review.
The public hearing was opened.
No one spoke for or against the request.
The public hearing was closed.
Discussion followed on:
• the street is a public street but maintained by the applicant
• no negative future impact foreseen
Commissioner Adkins made the motion to approve the request with staff
recommendations. The motion was seconded by Commissioner Sturgill and roll call
vote showed all members present in favor of the motion.
OTHER ITEMS:
Item#3 Consideration of the Preliminary Plat of the Morning Sun Subdivision, 98.4 (+/-) acres,
located south of Falls Ave East, east of Carriage Lane (extended), west of Hankins
Road/3200 East Road and north of Filer Ave East in the City's Area of Impact.
RESCHEDULED FOR APRIL 9, 2002 MEETING.
Item#4 Preliminary presentation of Hankins Corner, LLC requests a Zoning District Change and
Zoning Map Amendment from RR (Rural Residential) to R-2 PUD (Residential; single
or duplex), R-2 PRO PUD (Residential; single or duplex with a professional office
overlay) and R-2 NCO PUD (Residential; single or duplex with a neighborhood
commercial overlay) for approximately 36.53 acres located south of Falls Avenue East
and west of Hankins Road in the City of Twin Falls' Area of Impact.

Fran Florence, 4129 Hidden Lakes Drive, reviewed his project using overhead
projections.
Discussion followed on:
• what is build out period between residential and commercial
• hopefully commercial will come early in the project
• the applicant would like to start this construction season
• project looks good for the area
• what plans for school pedestrian crossing and neighbors for crossing Falls
• no sidewalks are out there
• how will project impact School District
• only certain builders will be allowed to build in the project
• time frame on construction completion
• an anticipated seven year build out is expected
• Phase I will be commercial and corridor of houses fronting commercial
• no parks are planned—there is a lot of open space
• pro-overlay is proposed on Hankins Road
• neighbors are generally against commercial
Public comments were taken:
Jay Sudweeks 1124 Skyline Drive, was concerned whether the area would be annexed
into the City. He also requested a copy of the CC and Rs.
Mr. Florence said he and his wife and Doug and Teresa McCoy are the only investors at
this time. The other investors won't do unless the project is approved. Mr. Florence felt
the area would be annexed once the City services were in use.
City Engineer Young reviewed three documents that are required by the City when
developers are outside the City Limits.
Mr. Florence said he hoped the green area would be maintained with City participation.
He said the CC and Rs would be made available to the neighbors when completed.
Craig Crandall, 1095 Skyline Drive, said the lots in the project are smaller than other lots
in the area. Could they be made bigger?
Todd Minco, 1165 Skyline Drive, felt Falls Avenue was too dangerous for children to
cross—he was against the project.
Scott Allen 2923 Skyline Drive, said safety was a concern.
No action was taken on this item.

ANALYSIS: The site is currently zoned airport (AP) in the
City's area of impact. The Planning & Zoning
Commission recommended approval of a request
to rezone the property from AP to M-1 (light
industrial). The request is scheduled to be heard
before the City Council on March 18th, April 1st
and April 15th. In the M-1 zoning district a
special use permit is required for manufacturing of
metal products.
The applicant wishes to expand an existing
business located on the property by adding an
additional building. The buildings will be used
primarily for Mr. Edwards' sculpturing business.

during the public hearing on Tuesday, March 26, 2002, at 7:00 p.m. in the Council
Chambers, 321 2nd Ave East (City Hall), Twin Falls, Idaho. This item has been
scheduled as Item #1 on the agenda.
Staff will provide overhead copies of the area map, the site plan and any other

Physical Characteristics: Existing residence with farm
ANALYSIS: The site is currently zoned airport (AP) in the
City's area of impact. The Planning & Zoning
Commission recommended approval of a request
to rezone the property from AP to M-1 (light
industrial). The request is scheduled to be heard
before the City Council on March 18th, April 1st
and April 15th. In the M-1 zoning district a
special use permit is required for manufacturing of
metal products.
The applicant wishes to expand an existing
business located on the property by adding
additional buildings. The buildings will be used
primarily for Mr. Edwards' sculpturing business.
There are currently two buildings on site totaling
7000 s.f. The requested buildings will be added
in two phases. Phase #1 will include two
buildings: one will be 2,016 s.f., 36'X56', and
the second building will be 5,000 s.f., 50'X100'.
Phase #2 will be a 12,500 s.f., 100'X125'
addition to the second building mentioned above
making that building a total of 17,500 s.f. The
site plan is not to scale. The site plan does not
show building separation dimensions or minimum
yard separations. The applicant needs to work
with the Building and Fire Departments to work
out building separation distances to meet code
requirements.
The Twin Falls County Planning & Zoning
Commission reviewed a similar request to add an
additional building at this site They made a
determination that the use was not agricultural in
nature and referred Mr. Edwards to the City.
There is no City water or sewer service in the
area.

RECOMMENDATIONS: Staff recommends the following condition be
placed on this permit, if granted:
1 . The buildings to meet all building and fire
code requirements.
2. Dedicate 15' of additional right-of-way along

A. The reason for this request is that I desire to build an additional building at my
present location in order to increase the size of my sculpting business. The
property has been rezoned to M1 and meets the comprehensive plan for the City
of Twin Falls. I have lived on this property 29 years and have farmed it and also
conducted my sculpting business from this location. I have been granted building
permits on two prior occasions but now need a special use permit for this new
growth.
B. There will be no significant change in operations,traffic,or employees with this
new building. The hours of operation are basically 8-5,Monday through Friday.
This building is needed to allow space for the growth of my sculpting business.
C. The effect on adjoining property is negligible and is not a change over what has
been at this location for many years. I have talked to all of my neighbors and
they have encouraged me to continue. It is a clean,honest business that is
completed entirely inside the buildings and causes no concern to the neighbors.

This matter having come before the Planning and Zoning Commission of the City of
Twin Falls, Idaho on March 26, 2002 for public hearing pursuant to public notice as required by
law for a Special Use Permit to expand an existing metal sculpting business on property located at
2763 East 3400 North, and the Planning and Zoning Commission having heard testimony from
interested parties being fully advised in the matter, now makes the following
FINDINGS OF FACT
1 . Applicant has applied for a Special Use Permit to expand an existing metal
sculpting business on property located at 2763 East 3400 North.
2. All legal requirements for notice of public hearing have been met with
advertisement taking place on the following date: March 7, 2002.
3. The property in question is zoned M-1 within the Area of Impact pursuant to the
Zoning Ordinance of the City of Twin Falls. The property is designated as Industrial/Airport in the
duly adopted Comprehensive Plan of the City of Twin Falls.
4. Relevant criteria and standards for consideration of this application are set forth in
Sections 10-1-4, 10-1-5, 10-4-9.2(B)6g and 10-13-2.2 of the Twin Falls City Code.
5. The existing neighboring land uses in the immediate area of this property are: to
the north, 3400 North Road/Twin Falls County/agricultural; to the south, agricultural; to the east,
residential/agricultural; to the west, residential/agricultural.
6. The proposed use is consistent with the purpose of the M-1 Zone and would not
be detrimental to any outright permitted uses or existing special uses.
7. Any detrimental effects on the neighborhood would be ameliorated by observance
of the conditions which are attached as "Exhibit No. A", and incorporated by reference as though
fully set forth herein.
8. Additional findings: 1) The applicant has an existing sculpting business. 2) The
applicant agreed to the conditions placed on the permit.
Based on the foregoing Findings of Fact, the Planning and Zoning Commission hereby
makes the following

1 . The application for a Special Use Permit to expand an existing metal sculpting
business on property located at 2763 East 3400 North is consistent with the purpose of the M-1
Zone, and is not detrimental to any of the outright permitted uses or existing special uses in the
area.
2. The proposed use is consistent with the provisions of the Comprehensive Plan and
Zoning Ordinance of the City of Twin Falls, and in particular Sections 10-1-4, 10-1-5,10-4-
9.2(B)6g and 10-13-2.2 of the Twin Falls City Code.
3. The proposed use is a proper use in the M-1 Zone, subject to the conditions which
are attached as "Exhibit No. A", and incorporated by reference as though fully set forth herein.
4. The application for a Special Use Permit to expand an existing metal sculpting
business on property located at 2763 East 3400 North should be granted, subject to all
applicable requirements of the Zoning Ordinance, Adopted Standard Drawings and City code of the
City of Twin Falls and to the conditions, which are attached as "Exhibit No. A", and incorporated
by reference as though fully set forth herein.
Based on the foregoing Conclusions of Law, the Twin Falls City Planning and Zoning
Commission hereby enters the following
