Applicant has applied for a Special Use Permit for the purpose of allowing and automobile, truck sales and/or rental business at 1237 Blue Lakes Boulevard North. 2. All legal requirements for notice of public hearing have been met with advertisement taking place on the following date: May 24, 2007. 3. The property in question is zoned C-1 pursuant to the Zoning Ordinance of the City of Twin Falls. The property is designated as Commercial/Retail in the duly adopted Comprehensive Plan of the City of Twin Falls. 4. The existing neighboring land uses in the immediate area of this property are: to the north, Evergreen Street; to the south, Oasis Stop `N Go; to the east; Blue Lakes Blvd N; and to the west, Lincoln Street Based on the foregoing Findings of Fact, the Planning and Zoning Commission hereby makes the following CONCLUSIONS OF LAW 1. The application for a Special Use Permit for the purpose of allowing and automobile, truck sales and/or rental business at 1237 Blue Lakes Boulevard North is consistent with the purpose of the C-1 Zone, and is not detrimental to any of the outright permitted uses or existing special uses in the area. 2. The proposed use does constitute a special use as established by zoning requirements for the zone involved as required by Twin Falls City Code 10-13-2.2(D)1. 3. The proposed use will be harmonious with and in accordance with the general objectives or with any specific objective of a comprehensive plan and/or zoning regulations as required by Twin Falls City Code 10-13-2.2(D)2 4. The proposed use will be designed, constructed, operated and maintained to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity and that such use will not change the essential character of the same area as required by Twin Falls City Code 10-13-2.2(D)3. 5. The proposed use will not be hazardous or disturbing to existing or future neighboring uses as required by Twin Falls City Code 10-13-2.2(D)4. 6. The proposed use will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community as required by Twin Falls City Code 10-13-2.2(D)6. 7. The proposed use will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any person, property or to the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors as required by Twin Falls City Code 10-13-2.2(D)7. 8. The proposed use will have vehicular approaches to the property which shall be so designed as not to create an interference with traffic on surrounding public thoroughfares as required by Twin Falls City Code 10-13-2.2(D)8. 9. The proposed use will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance as required by Twin Falls City Code 10-13-2.2(D)9. 10 The proposed use is a proper use in the C-1 Zone, subject to the conditions which are attached as"Exhibit No. A", and incorporated by reference as though fully set forth herein. 11. The permit had a condition that the approval was only for one-year as there were concerns raised about compliance with the sign and landscaping code. Budget Impact: Approval of this request will not impact the City budget Regulatory Impact: Approval of this request will allow the applicant to continue to operate an automobile sales and service business that was expanded by more than 25%. Analysis: This site is zoned C-1, Commercial Highway zoning district The Middlekauff Honda dealership at this location received Special Use Permit#0977 on May 9, 2006,for expansion of the facility. The permit had a one-year expiration condition and the applicant is requesting for the continuation of the Special Use Permit so that the facility may continue operation. The hours of operation are to remain the same as 7:30 am to 8:00 pm for the showroom and 7:30 am to 6:00 pm for the service department The number of employees at the dealership is thirty. Traffic patterns and volume are anticipating to stay the same. Blue Lakes Boulevard North is a high volume traffic corridor that is designed to accommodate a lot of vehicles. The building was designed to reduce sound from the service bay to surrounding properties and lighting on the property has not been altered. The continuation of this permit would,not pose any additional glare or lighting intrusions and any odors, fumes, or vibrations would be minimal and contained as much as possible. Concerns expressed in the staff report and Planning and Zoning Commission public hearing in May 2006 were about signage and parking. There were numerous and continual displays of non-permitted signage and vehicles parked on landscaping and in the vision-sight triangles. The condition of a one-year expiration of the Special Use Permit was to allow the Planning and Zoning Commission to review the operation of the facility and compliance with code regulations. There have not been any complaints regarding the display of vehicles as they appear to be parked on the pad sites. While sign code violations exist on other Middlekauff properties, this site has only received one complaint in the past year in regards to a sign code violation. Banner signs were placed at the intersection of Blue Lakes Boulevard and Evergreen Drive. The banner signs were removed before the Planning Department contacted them regarding the sign code and sight triangle vision violation. If continued compliance is a concern than the Planning and Zoning Commission may want to include a condition requiring an annual review. This would allow for compliance practices to be evaluated yearly. A special use pemtit is for zoning purposes only. Other permits such as sign, building, electrical or plumbing permits,etc.may be required. All facilities must comply with all Building and Fire Code Regulations. Conclusion: Should the Commission approve the request,staff recommends the following conditions: 1. The original permit was for one year and we would ask that time to be extended. There has been no change of use at the site,nor do we anticipate any. We would like to continue to operate our dealership, contributing to the City of Twin Falls commerce.as we have In the past. Commissioner Frank stepped down from the Commission. Item#7 Request of Gregg Middlekauff or a Special Use Permit to expand by more than 25% existing automobile sales and service business on property located at 1237 Blue Lakes Boulevard North. Barrett Craig, Balteus Design Group, representing the applicant, explained the request using overhead projections. Middlekauff Auto Group is requesting a revised Special Use Permit to construct a new Honda dealership facility on their existing Mitsubishi building and the construction of a completely new building. The project will consist of a new 12,062 sq. ft. showroom, offices, and service facility. The building would be constructed out of painted split faced concrete block, steel, and synthetic stucco. Landscaping will be placed. Currently the existing building has water leakage and the utility location has been a continual problem. A sign in the site triangle has been removed. Discussion followed: -Reported ongoing sign code violations. Barrett Craig stated that he did not understand signage regulations and would work with staff to comply. He stated that Rex Lytle, Lytle Signs, does all signage for Honda. Zoning and Development Manager Carraway reviewed the request using overhead projections. The property is located in a C-1 zoning district of the City. In that district, to establish automobile sales and service business and any expansion greater than 25% of such, a business requires a Special Use Permit. The proposed building constitutes an expansion greater than 25%. Non-permitted signage and parking vehicles on the landscaping and in vision site triangles on the landscaping have been consistent concerns for this property. There were thirty (30) sign code violations noted during a site inspection on May 1, 2006. There is no guarantee if these violations are brought into compliance they will remain in compliance. On May 9, 2006, an on-site inspection showed there is only one remaining violation, which is the construction sign. Due to the history of violations occurring at this site, if the Commission approves this permit this evening, it may be appropriate to place a time limit on the permit. Staff recommends the following conditions be placed on this permit, if granted: 1. Subject to plan amendments as required by building, engineering, fire, and zoning officials to ensure compliance with all applicable City Code requirements and standards. 2. Compliance with the City of Twin Falls sign code. 3. Compliance with the City of Twin Falls code requirements for parking on the landscaping. 4. Approval subject to 1-year. Discussion followed: Commissioner Stroder requested Mr. Middlekauff state for the record that he would work with staff to comply with signage regulations. Greg Middlekauff, owner, explained that he did not understand signage regulations but that he would comply. Commissioner Stroder suggested that Mr. Middlekauff become proactive and contact the City before placing signs. The public hearing was opened and closed with no input. Barrett Craig stated that the signage regulations were difficult to understand. He also commended the owner for hiring businesses in state. Deliberations followed: -Limiting the permit to one year. -Revocation of a Special Use Permit. Commissioner Warren made a motion to approve the permit as presented with staff recommendations. The motion was seconded by Commissioner Stroder and roll call vote showed all members present voted in favor of the motion. The original permit was for one year and we would ask that time to be extended. There has been no change of use at the site, nor do we anticipate any. We would like to continue to operate our dealership, contributing to the City of Twin Falls commerce, as we have in the past. The hours of operation remain the same, as the showroom is open from 7:30 in the morning till 8:00 in the evening, and the Service department operates from 7:30 in the morning till 6:00 in the evening. Also, as this is an existing automotive dealership, the traffic volume and patterns will remain the same. The number of employees is about 30. The property is fronted by Blue Lakes Blvd. To the north of the property is our Middlekauff Ford LM Dealership. To the west is Middlekauff Automotive Group's used vehicle facility and accounting offices, and an employee parking lot beyond that. To the south of the property is the Oasis Stop 'N Go convenience store and Car Wash facility. The building is constructed in such a way as to keep noise coming from the service bay minimal to adjoining properties. The exterior lightings on the building itself are accent lights that shoot straight up and down the walls, and the site lighting remains the same so there should not be any additional glare or lighting intrusions.
