I was forwarded your email from Jody in our Planning & Zoning Department. I will
answer your questions about the documents attached to your email.
• The "Improvement Agreement for Constructing Extensions of the City Water
Main" that you reference is the full document. There are no additional pages.
• The letter from the attorney is implying that the 6" water main was an unknown
entity on the site. This is incorrect for the following reasons:
• The letter states that "workers discovered an 8" water line that runs more or less
parallel with the northern boundary of its parcel". The water line is clearly shown
on the construction plans as an existing line and there is a note stating "approximate
location of existing water line". As stated in that same paragraph, it is correct that
the 6" water main is connected to the City water main and serves two fire hydrants
located on the Bridgeview Estates facility.
• The letter goes on to say, "the existence and location of the water line was not
identified by the utility locating service, nor was it identified by the title company".
The existing water line would have been located during the site survey and design
process by the Engineer of Record that the developer hired to do the site design.
• It does not appear that there is an easement on the existing water line. This is why
an easement would not have been part of the title report for this property.
