Dear Mr. Honsinger: In a letter dated January 28, 2002 you stated the Serrano's received a letter from the City of Twin Falls demanding the removal of signs from their property without explaining the reasons for such a demand. On April 19, 2001 the City Council denied a request to place a sign, code section 10-9-2(0), on their property located at 273 Shoup Avenue West. The Council did suspend, for 100 days, any zoning action on the sign illegally placed on the Serrano's property to give the Serrano's an opportunity to apply for a zoning code change to allow signs for private educational facilities In the R-6 Zone, if they so decided. July 18, 2001 was the end of the 100-day suspension granted by the City Council. On July 19, 2001 the sign had not been removed. The City of Twin Falls sent the Serrano's a letter dated July 19, 2001 requesting the removal of the sign within five (5) days from the date of the letter. Upon inspection on August 3, 2001 the signs had been removed. On December 14, 2001 the City of Twin Falls received a complaint the signs were again placed on their building. There are a number of items that need to be addressed, and they are listed below: �1. Section 305.1. Due to the ages of the children to be served at this facility, I feel it is inappropriate to classify the building E-1. After careful research, I have come to believe that the intent of the Code in creating the E-3 classification was to designate a group of occupants based more on their age and capability rather than based on whether they are being educated or merely watched. .f2. Table 10-A. I believe it is more appropriate to use the occupant load factor and minimum number of exits described for day care rather than for classrooms, again because of the ages of the children involved. Therefore, two exits are required from a space where the number of occupants is at least seven. 3. Section 1004.2.6. You have a dead-end hallway in excess of 20 feet in length. /4. Section 1007.3.3.1. The travel distance from any point in a room shall not exceed 75 feet to a corridor or an exit (90 feet in one- or two-story buildings that are protected throughout by smoke detectors). Classrooms 4 and 5 are non-compliant. 5. Section 1004.2.2. See exception 4 on intervening rooms. 6. Section 1003.3.3.2. The stairway needs to have a finished minimum width of 36". 7. Section 305.9. Provide an approved fire alarm system in compliance with the Fire Code. 8. Bearing wall foundation. Area of thickened slab under bearing wall that separates classrooms 3 and 5 is shown incorrectly on sheet 2. There are many ways in which these issues could be addressed. One suggestion would be to provide the second exits directly to the outside for classrooms 1, 4, 5, and 6. Doing this would solve the non-compliance issues itemized in items 2, 3, 4 and 5 above. I know you are out of town and will be away for several weeks. I have talked with the owner Rick Serrano and have agreed to issue him the permit with special provisions limiting how far he can proceed on the project before these issues are resolved.
