Thank you for taking the time to speak to me regarding the status of your claim.
The Charter Oak Fire Insurance Company("Travelers")is the general liability Loss location:
carrier for the City of Twin Falls. In that capacity, we acknowledge your claim for 863 ELM STREET N
property damage due to a sewage backup into your home located at 863 Elm St. TWIN FALLS ID 83301
in Twin Falls, ID on 01/21/2024.
Based on the information received and our investigation into the facts of loss, we
have determined that our insured is not liable for your damages.While our
insured does own the line where the blockage was found,this simple control of
public property does not automatically constitute liability in the event of a loss.A Claimant name: ERIC MORRISON
governmental entity must have received a prior request for maintenance or
repairs and failed to act on that request within a reasonable time frame to be Underwriting THE CHARTER
considered negligent_Further,the blockage in this case was found to consist of Company: OAK FIRE
grease and various paper and non-flushable materials that should not have been INSURANCE
introduced into the line. COMPANY
As such, we must respectfully decline your claim based on a lack of negligence
on the part of the City of Twin Falls. If there is additional information that you
would like me to consider, please submit it for review.
