Due to the wet conditions the large trees located on the south side of the apartments have not been installed. The trees have been purchased and are in our possession. Due to thi! size of the trees, larger equipment is needed for installation. The site needs a few days of dry weather to allow final tree installation. Sod will be installed immediately following; trees in this area of the site. In addition the sod, sprinkling and general landscaping details will be completed in, under and around the area called the marketing trailer as soon as it is moved and a marketing staff is able to conduct their business out of the main building. It is our desire to have these landscaping details wrapped up in the first 10 days in the month of May Carpeting. A last minute upgrade in the hallway carpeting has resulted in a slight delay. Great Floors of Boise, Idaho is the supplier and installer. The hallway carpet in the east and wesr wings has been delayed due to the addition of a carpet border in all areas of all hallways. There was a delay in receiving the additional carpet border. It is our commitment to have this flooring detail completed within the first 10 days of the month of May. Both of the above items will be completed prior to the occupancy of the building by any new tenants. It is ou:- request at this time to be granted an occupancy permit, dated no later than April 28, 2(►06, that is contingent upon any unresolved or uncompleted details. You have the commitment of Mr. Tom Mannschreck of Thomas Development, and Mr. Bill Markovich of Markovich Construction that no occupancy will take place prior to the completion of both of the above detailed items. They have approved the attached landscape plans subject to the following clarifications all of which are acceptable to me: 1. The Austrian Pine shown as 12 feet shall be placed on top of a berm with a 2-3 foot crown subject to EHM Engineers determining such berm is compatible with the grading and • drainage plans. If the berm is not compatible for lesser height,the trees will be increased in height to the point where the top of the trees are 14 feet above native grade. 2. Lighting on the building in the parking area shall be indirect with no exposed bulbs. 3. Dumpster enclosures (most likely one on each end of the building) shall be enclosed and placed in the northerly portion of property. I advised the neighbors that we would work with the trash vendor to accommodate their desires but frequently trash vendors have very strong opinions on where dumpsters are located to facilitate pick up. 4. The 8 foot vinyl fence,part of the previous conditions,shall be beige,gray or tan in color. I advised the neighbors we would bring samples over prior to starting construction in an attempt to achieve a consensus amongst the neighbors on an approved color. Please place this letter and attached plan with the record file for Blackhawk Subdivision and Devon Senior Community. Thank you for your courtesy and cooperation. G. FEES. Developer shall pay, or cause to be paid, to the City all applicable fees, if any, with regard to the installation of Improvements pursuant of the Improvement Plans. However, City water and sewer connection and service charges shall be paid for by individual developers and users at the rates set by applicable City ordinances and resolutions. H. PLATS. Developer agrees to file with City preliminary plat, or plats in phases, prepared by a registered professional engineer, of the real property which is the subject of this Agreement. The Property or any portion thereof shall be developed in accordance with criteria set forth in this Section 5, and all applicable provisions of the City Code. A. APPROVAL AND CONSTRUCTION. All improvements shall be constructed in accordance with engineered drawings and specifications, described in reasonable detail the work to be performed, with drawings and specifications to first be approved by City, which approval shall not be unreasonably withheld, being understood by the Developer that the City does not guarantee availability of sewer, water and other services. B. LANDSCAPING AND PLANTING. Perimeter landscaping along bordering and interior streets shall be required to be installed on each parcel of the Property and in the public right-of-way adjacent thereto at the time site and building improvements are completed thereon, or by the next planting season. Such landscaped perimeter shall be installed from the back of the curb in the public right-of-way and shall be extended to the dimensions set forth below. A 35-foot wide (including meandering sidewalk) Iandscape buffer area, measured from the back of the curb will be constructed along Blue Lakes Boulevard North. A landscaped buffer area amem" not less than 15 feet in width, not including sidewalk, shall be provided along the south boundary of North College Road in Zone I only, adjacent to Lot 3, Block 2 and a landscaped buffer area not less than 15 feet r 8 (exclusive of sidewalk) shall be provided along the rest of North College Road and along the west side of Locust Street North. To accommodate construction of North College Road and the Blue Lakes Boulevard turn lane, the landscaping width for Lot 1, Block 1 may be an average of 35 feet on Blue Lakes Boulevard and 15 feet on North College Road. Said landscaping shall not preclude access drives. The property shall meet or exceed the minimum landscaping and planting requirements established by the City. The landscaping shall be evaluated on a Project-wide basis to.insure landscaping where it has the greatest benefit to the Project and to adjacent property owners. All landscaping shall comply with the standards set forth herein, and be installed in conformance with an approved Project Master Landscaping Plan as approved by City staff All landscaping will be properly maintained. The property landscaping will be designed to utilize' a pressure irrigation system when available. C. LANDSCAPING PLAN. Each street buffer area, at the time of development, shall be landscaped to include the following: The landscape perimeter may be planted in grass, and shall have a minimum of one shrub per 100 square feet of landscaped area and one tree per 500 square feet of landscaped area. Trees and shrubs may be clustered, but there shall be no space greater than 75 feet between shrubs/trees. A minimum of 50 percent of trees should be evergreens. Deciduous trees 9 shall be at least two-inch caliper and evergreen trees shall be a minimum of 6 feet in height. Any continuous landscaped strip exceeding forty feet (40') in length shall contain a twelve-inch (12") minimum height undulating berm. Each separate section of the landscaping strip shall contain trees or shrubs. The use of planters and landscaped islands within parking lots will be used to reduce visual impact of large paved areas and these shall be planted with shade trees and shrubbery. The design shall include consideration of draught resistant plants and materials. There shall be a seven (7) foot solid vinyl screening fence topped with a one (1) foot decorative top adjacent to all residential properties, including the Alterra project, unless waived by the neighboring property owner. Fence for each lot shall be installed prior to any building construction on each lot. Development of lots 1 and 2, block 2 with two-story residential use shall include landscaping of sufficient height to minimize unobstructed sight of neighboring properties. Building and site development plans shall include a detailed landscaping plan that will specify landscape materials, sizes, and spacing.
