DESCRIBE IN DETAIL WHAT DAMAGE OR INJURY OCCURRED:
This issue began around May 7,2021,when the city sanctioned an event where an organization operated as a vendor.My tort claim begins
today,as I was never informed that filing a tort claim was an option,nor was I made aware of its existence.I am only now discovering that
the city permitted an organization to operate as a vendor despite this being in violation of the commerce grant.A recent audit confirmed
that this organization was never authorized to act as a vendor,leading to the termination of the grant director.Since this critical information
has just come to light,I am exercising my right to file this claim based on the city's failure to enforce proper regulations.
Due to the city's negligence in allowing an unauthorized vendor to operate,I suffered a financial loss of$100,000 in stolen equipment.This
equipment was unlawfully taken and subsequently used by the unauthorized organization to generate revenue for its operations,despite
not being permitted to act as a vendor.Each year,the event generated approximately$100,000 in revenue,even though it was not
authorized to do so.
The direct impact of this negligence includes:
• Financial loss from stolen equipment,which was then exploited for profit by an entity that was never authorized to operate.
• Unjust enrichment,as the unauthorized vendor gained an unfair financial advantage by using my stolen equipment to generate
revenue.
• City negligence,as the city's failure to properly vet and enforce vendor regulations allowed an unauthorized entity to operate for
multiple years,causing me substantial harm.
I am seeking full restitution for my financial losses,including the value of the stolen equipment and any damages caused by the city's failure
to prevent this unauthorized operation.
The total cost of property damage is around$100,000,The invoices supporting this claim have been provided to the city,which represents
the value of the stolen equipment.This loss directly resulted from the city's negligence in permitting an unauthorized vendor to operate.
As of February 14,2025,the event no longer generates the same revenue as it did when it began.This is indicated in the organization's
minutes.Initially,it was making approximately$100,000 per year,but the exact amount of revenue gained by the unauthorized vendor over
time is unknown.This information is with https://www.tickettailor.com/or the organization's accountant.Therefore,while the precise
financial impact beyond the stolen equipment is uncertain,the city's negligence enabled the unauthorized vendor to profit from my
property.
I request full restitution for the stolen equipment and any additional damages that may be determined based on further review.
Additionally,the city's contract governing the event,as well as audits that validate this claim,are with the city's records.
